<strong>Report</strong> <strong>of</strong> <strong>the</strong> <strong>Bahrain</strong> <strong>Independent</strong> <strong>Commission</strong> <strong>of</strong> <strong>Inquiry</strong><br />

974. At 20:15 on 5 April 2011, Ms Khadija Merza Abbas Yusuf Abdulhai<br />

was pronounced dead. The death certificate states that <strong>the</strong> cause <strong>of</strong> death was<br />

bilateral modular diseases and acute pneumonitis caused by severe septic<br />

shock.<br />

975. The <strong>Commission</strong> received information that on 15 March 2011 Ms<br />

Abdulhai inhaled large quantities <strong>of</strong> tear gas after it was released in <strong>the</strong> open<br />

yard <strong>of</strong> her home. Her family took her to SMC but was advised to bring her<br />

back <strong>the</strong> following day. The family was unable to access <strong>the</strong> appropriate<br />

hospital facilities until 20 March 2011, at which point <strong>the</strong> deceased was<br />

hospitalised and treated for a five-day period. The deceased’s condition<br />

progressively worsened. Her heart stopped on 5 April 2011 and she was taken<br />

to <strong>the</strong> Intensive Care Unit where she died later that day.<br />

976. The exact circumstances <strong>of</strong> this death are unknown. Consequently,<br />

<strong>the</strong> <strong>Commission</strong> is unable to determine whe<strong>the</strong>r <strong>the</strong>re was an excessive use <strong>of</strong><br />

force or to attribute this death to a particular agency.<br />

Case No. 19 - Alsayed Hameed Mahfoudh Ibrahim Mahfoudh<br />

977. On 6 April 2011, Mr Alsayed Hameed Mahfoudh Ibrahim Mahfoudh<br />

was pronounced dead. The death certificate states that <strong>the</strong> cause <strong>of</strong> death was<br />

respiratory and circulatory failure.<br />

978. A forensic report confirmed <strong>the</strong> cause <strong>of</strong> death and concluded that <strong>the</strong><br />

body <strong>of</strong> <strong>the</strong> deceased was found on Al Budaiya Road behind Al Aziziya<br />

Complex.<br />

979. The <strong>Commission</strong> received information that <strong>the</strong> deceased left his home<br />

at approximately 20:30 on 6 April 2011. After several hours, a relative called<br />

<strong>the</strong> deceased on his mobile phone to ask about his whereabouts, but <strong>the</strong><br />

deceased did not answer. The relative <strong>the</strong>n left <strong>the</strong> house to search for <strong>the</strong><br />

deceased. The deceased’s relative stated that <strong>the</strong> next morning, <strong>the</strong> family<br />

went to Al Budaiya police station. The relative stated that <strong>the</strong>y saw <strong>the</strong> car <strong>of</strong><br />

<strong>the</strong> deceased inside <strong>the</strong> police station and that one <strong>of</strong> <strong>the</strong> family members<br />

attempted to approach <strong>the</strong> vehicle but was stopped by police. They continued<br />

to look for <strong>the</strong> deceased and at about 20:30 <strong>the</strong>y found his body close to Al<br />

Aziziya complex on Al Budaiya Road. The car <strong>of</strong> <strong>the</strong> deceased had been<br />

moved from inside <strong>the</strong> police station to <strong>the</strong> parking lot <strong>of</strong> a nearby c<strong>of</strong>fee<br />

shop. Relatives <strong>of</strong> <strong>the</strong> deceased stated that <strong>the</strong> body was found inside a large<br />

black plastic bag and that <strong>the</strong> police refused to examine <strong>the</strong> body for some<br />

time. The body had evidence <strong>of</strong> physical assault and <strong>the</strong>y believe that <strong>the</strong><br />

cause <strong>of</strong> his death was suffocation.<br />

980. The <strong>Commission</strong> considers that <strong>the</strong> death <strong>of</strong> Mr Mahfoudh was an<br />

unlawful killing. The fact that <strong>the</strong> deceased was found inside a plastic bag and<br />

<strong>the</strong> evidence <strong>of</strong> suffocation are indicative <strong>of</strong> an unlawful killing. The<br />

<strong>Commission</strong> is unable to attribute this death to a particular agency or group <strong>of</strong><br />

civilians.<br />
