Chapter VI — Allegations <strong>of</strong> Human Rights Violations Against <strong>the</strong> Person<br />

981. On 18 September 2011, Mr Jaafar Hasan Yusuf was pronounced<br />

dead. No autopsy was conducted and no formal cause <strong>of</strong> death has been<br />

recorded.<br />

982. The <strong>Commission</strong> received information that, on two occasions in<br />

March 2011, security forces came into <strong>the</strong> deceased’s home searching for his<br />

bro<strong>the</strong>r. Witnesses stated that <strong>the</strong> deceased was physically attacked on both<br />

occasions, causing severe bruising to his body. He was <strong>the</strong>n admitted to SMC<br />

for approximately three days. Thereafter, he went to receive treatment in<br />

Jordan where he was diagnosed with Hepatitis and a bowel perforation. He<br />

subsequently returned to SMC. The deceased’s health began to deteriorate<br />

and he was admitted to <strong>the</strong> Intensive Care Unit <strong>of</strong> SMC on 8 August, where he<br />

remained until 18 September 2011 when he died.<br />

983. The exact circumstances <strong>of</strong> this death are unknown, and consequently<br />

<strong>the</strong> <strong>Commission</strong> is unable to determine whe<strong>the</strong>r <strong>the</strong>re was an excessive use <strong>of</strong><br />

force or to attribute this death to a particular agency or group <strong>of</strong> civilians.<br />

Case No. 21 - Abdulrasool Hasan Ali Mohamed Hujair<br />

984. On 20 March 2011, Abdulrasool Hasan Ali Mohamed Hujair was<br />

pronounced dead. The death certificate states that <strong>the</strong> cause <strong>of</strong> death was<br />

traumatic injuries to <strong>the</strong> chest, stomach, back and limbs, which led to bleeding<br />

and shock.<br />

985. The <strong>Commission</strong> received information that at approximately 19:00 on<br />

19 March 2011 <strong>the</strong> deceased was expected to return home after <strong>the</strong> Maghreb<br />

prayer. His relatives heard shots being fired and knew that most roads were<br />

closed. They stated that when <strong>the</strong> deceased did not return home after two<br />

hours, <strong>the</strong>y called his mobile phone three times. His relatives attended <strong>the</strong><br />

nearby police station to lodge a missing person complaint, but were told that<br />

<strong>the</strong>y could not do so until he had been missing for 24 hours. The following<br />

day, ano<strong>the</strong>r relative called <strong>the</strong> family and told <strong>the</strong>m that <strong>the</strong> body <strong>of</strong> <strong>the</strong><br />

deceased was at <strong>the</strong> SMC morgue. They were told that <strong>the</strong> body had been<br />

found in Awali, a sparsely populated area north <strong>of</strong> Riffa. The relatives stated<br />

that <strong>the</strong>re were marks all over <strong>the</strong> deceased’s body and a fracture <strong>of</strong> his skull.<br />

986. The death <strong>of</strong> Mr Hujair can be attributed to <strong>the</strong> use <strong>of</strong> excessive force<br />

by unknown persons. The fact that <strong>the</strong> deceased sustained multiple traumatic<br />

injuries indicates that <strong>the</strong>re was no justification for <strong>the</strong> use <strong>of</strong> lethal force. The<br />

<strong>Commission</strong> is unable to attribute this death to a particular agency or group <strong>of</strong><br />

civilians.<br />

c) Deaths Caused by Torture<br />

Case No. 22 - Hasan Jassim Mohamed Maki 525<br />

987. At approximately 10:30 on 3 April, Mr Hasan Jassim Mohamed Maki<br />

was pronounced dead. The death certificate states that <strong>the</strong> cause <strong>of</strong> death was<br />

heart failure and cessation <strong>of</strong> breathing due to sickle cell anaemia.<br />
