5.4 ANNEX – MARKET REGULATING POLICIES<br />

The policies of regulating the market deal with transmission (the pibes) and the content (what is<br />

transmittedthrough them).<br />

Regulations of transmission:<br />

A new electronic communications regulatory framework that covers the management of scarce resources<br />

essential to communications.<br />

EU's new radio spectrum policy that focuses on communications networks and service. The radio spectrum<br />

policy covers all areas where spectrum is an issue, including mobile telephony , television broadcasting,<br />

satellite positioning systems and scientific research.<br />

EU’s Radio Equipment and Telecommunications Terminal Equipment (RTTE) Directive, regulates the<br />

telecommunications equipment market by replacing over 1000 national approval regulations.<br />

The Mobile Roaming Charges regulatory initiative reduces the cost of international roaming charges in<br />

Europe, and regulates the safety of ICT-related products.<br />

Regulations of content:<br />

European audiovisual regulation that aims to ensure the free provision of services, access to information and<br />

protection of users in areas such as commercial communication, protection of minors and human dignity. For<br />

example, it includes. the Television Without Frontiers Directive, which promotes the European broadcasting<br />

industry by ensuring the free movement of television broadcasting services throughout the EU and the Council<br />

Recommendation on the Protection of Minors and Human Dignity, which provides guidelines for national<br />

legislation in combating illegal and harmful content transmitted through electronic media.<br />

The EU's Single Market rules facilitate cross border transmission of audiovisual programmes via satellite and<br />

retransmission by cable. There are EU policies concerning Spam, Privacy and Data Protection.<br />

Finally, EU policies regarding content such as Web Accessibility, the Directive on the harmonization of<br />

certain aspects of copyright and related rights in the information society, Digital Rights Management and<br />

protecting databases and computer programs.<br />

The policies of Stimulating the Information Society focus on Research, Infrastructure and Content & Services and<br />

include a number of initiatives that all aim to strengthen the Digital Dividend:<br />

Regulation of research:<br />

A pillar for Investment and Innovation in Research has been established promoting innovation and<br />

technological leadership.<br />

Regulation of infrastructure:<br />

The electronic communications regulatory framework stimulates the development of Europe's infrastructure<br />

by promoting competition and growth. Bridging the Broadband Gap ensures that all regions of Europe benefit<br />

from broadband internet access.<br />
