Composition of the Council<br />

Article 22<br />

The Agency Council (hereinafter Council) shall have nine members, appointed from the<br />

ranks of reputed experts in fields relevant to conducting the affairs within the Agency’s<br />

competencies (media experts, advertising experts, lawyers, economists,<br />

telecommunication engineers, et al.).<br />

Council Appointment<br />

Article 23<br />

The Council members are appointed by the National Assembly of the Republic of Serbia<br />

(hereinafter: Assembly) at the proposal of authorised nominators.<br />

The authorised nominators shall be:<br />

1) The competent committee of the Assembly;<br />

2) The Assembly of the Autonomous Province of Vojvodina;<br />

3) The University conference;<br />

4) Associations of public media outlets in Serbia, associations of journalists in the<br />

Republic of Serbia, professional associations of film and drama artists in the Republic of<br />

Serbia and professional associations of composers in the Republic of Serbia by common<br />

agreement.<br />

5) Domestic non-governmental organisations and civic organisations primarily focusing<br />

on the protection of the freedom of speech, the protection of the rights of national and<br />

ethnic minorities and the protection of the rights of the child by common agreement;<br />

6) traditional churches and religious communities.<br />

The nominee for the ninth member of the Council shall be nominated by the previously<br />

appointed Council members whereby they must nominate a candidate residing and<br />

employed in the territory of the Autonomous Province of Kosovo and Metohia and<br />

fulfilling the criteria for membership in the Council set forth by this law.<br />

The nominee for the ninth Council member shall be proposed if at least five Council<br />

members have voted for him/her.<br />

Procedure for Nominating Council Members<br />

Article 24<br />

Each authorised nominator shall submit a list to the competent Assembly committee by<br />

obligatorily nominating two Council member nominees, with the exception of the<br />

competent Assembly committee, which shall propose a list by obligatorily nominating six<br />

nominees. Only one nominee shall be nominated for the election of the ninth Council<br />

member. Each nomination must be signed and sealed by the authorised nominator and<br />

include personal name and address of the representative.<br />

Nominees need not be from the ranks of the authorised nominator.<br />

The Assembly shall appoint one nominee from each valid list and three nominees from<br />

the list proposed by the competent Assembly committee.<br />

The authorised nominators shall draft their lists independently, and, if an authorised<br />

nominator comprises more than one legal person, the nomination shall be determined in<br />

agreement, by negotiations.<br />

The competent committee of the Assembly shall acquire the data on domestic nongovernmental<br />

organisations and civic associations from bodies competent for keeping<br />

records of these organisations i.e. associations.<br />

If the domestic non-government organisations and civic associations submit more than<br />

one nominee list, the list signed by a greater number of organisations or associations<br />

(authorised nominators) with a greater number of hitherto implemented activities,<br />

initiatives and published publications in the previous period in areas they primarily focus<br />

on shall be considered valid.<br />

If the nominee list has been submitted in contravention of the provisions of this Law, the<br />

competent committee of the Assembly shall return the submitted proposal to the<br />

authorised nominator to conform it with this Law within 15 days.<br />

If the competent committee of the Assembly is unable to determine which nominee list is<br />

valid, in respect of para 6 of this Article, it shall return the submitted nominations to the<br />

authorised nominators, in which case they are obliged to submit to the competent<br />

committee of the Assembly an agreed-on nomination within 15 days.<br />

The Assembly Speaker shall in an appropriate manner make public all valid nominee lists<br />

submitted by the authorised nominators together with the nominees’ brief curricula vitae<br />

at least 20 days before the decision on the appointment of Council members is taken.<br />

Before deciding on the appointment of the Council members, the competent committee of<br />

the Assembly may in an appropriate manner organise a public discussion with all<br />

nominees in order to gain insight in their abilities to fulfil the tasks within the Agency’s<br />

competencies.<br />

If no nominee on a Council member nominee list wins the sufficient number of votes, the<br />
