the screening of cinema films (normally not until 2 years after its release but 1 year in the case of films coproduced<br />

with the broadcaster);<br />

advertising standards (e.g. prohibition on the advertising of tobacco, medicines and prescription medical,<br />

in addition to restrictions on the advertising of certain products such as alcoholic beverages);<br />

advertising time (normally less than 15% of daily transmission time and less than 20% of any one hour<br />

period);<br />

advertising breaks programme sponsorship rules.<br />

The Declaration of the Committee of Ministers on freedom of communication on the internet elaborates on the<br />

principle of limited liability of service providers for Internet content. This principle entails that Member states<br />

should ensure that service providers are not held liable for content on the Internet when they merely transmit<br />

information or provide access to the Internet. However, such limitations should not affect the possibility of<br />

issuing injunctions where service providers are required to terminate or prevent, if possible, an infringement of<br />

the law.<br />

Policies regarding the protection of minors are addressed in CoE recommendations such as:<br />

Recommendation 1882 (2009). The promotion of Internet and online media services appropriate for<br />

minors;<br />

Declaration on Protecting the Dignity, Security and Privacy of Children on the Internet, adopted on 20<br />

February 2008;<br />

Recommendation CM/Rec(2009)5 by the Committee of Ministers to Member States on measures to<br />

protect children against harmful content and behaviour and to promote their active participation in the new<br />

information and communications environment, adopted on 8 July 2009.<br />

The study team finds that most of the issues addressed under CoE instruments are extensively covered by<br />

legislation at the EU level as addressed above and provides significant guidelines for Serbia’s way towards EU<br />

accession.<br />
