A fine in the amount of at least 10.000,00 Dinars shall also be imposed for the<br />
offences from items 1, 3, 4, 5, 6, and 7, paragraph 1 of this Article on the physical<br />
person who owns the radio station.<br />
Article 99<br />
A fine for an offence in the amount of at least 30.000,00 Dinars shall be imposed<br />
on a legal person if it:<br />
1. performs works near telecommunications facilities or other telecommunications<br />
equipment or builds facilities that may affect or interfere with their operation; or<br />
performs works near such facilities or equipment without the prior approval of the<br />
telecommunications operator (Article 88);<br />
2. builds, in a safety zone, radio stations or facilities or installations that may obstruct<br />
the propagation of radio waves or cause interference (Article 89);<br />
3. builds, uses or maintains power installations for transmission, distribution or use of<br />
electric energy, which are located near a telecommunications network so that they<br />
cause interference in the operation of that telecommunications network or endanger<br />
the life or health of people who perform the works on or operate that<br />
telecommunications network (Article 90);<br />
4. manufactures, puts into operation or uses power installations or other equipment or<br />
devices which cause electromagnetic interference to the telecommunications<br />
network or which do not have a certificate of compliance with the measures for the<br />
prevention of electromagnetic interference in the operation of the<br />
telecommunications network and reception of signals (Article 91).<br />
A fine in the amount of at least 3.000,00 Dinars shall be imposed for the offence<br />
from paragraph 1 of this Article to the responsible person or legal person.<br />
A fine in the amount of at least 30.000,00 Dinars shall also be imposed for the<br />
offence from paragraph 1 of this Article on the physical person with the status of an<br />
entrepreneur.<br />
A fine in the amount of at least 3.000,00 Dinars shall also be imposed for the<br />
offence from paragraph 1 of this Article on the physical person other than an<br />
entrepreneur.<br />
XI FINAL AND TRANSITIONAL PROVISIONS<br />
Article 100<br />
The Government shall submit a proposal for the appointment of the Chairperson<br />
and members of the Managing Board of the Agency within 30 days of this Law coming<br />
into force.<br />
The National Assembly of the Republic of Serbia shall appoint the Chairperson<br />
and members of the Managing Board of the Agency within 60 days of this Law coming<br />
into force.<br />
Article 101<br />
Within 60 days of this Law coming into force, the Government shall provide<br />
premises and create the technical, financial and other material conditions for the<br />
commencement of the work of the Agency.<br />
Within the period from paragraph 1 of this Article, the Government shall adopt<br />
the financial plan for the first year of the Agency’s operation, in accordance with Article<br />
19 paragraph 3 of this Law.<br />
Within six months from coming into force of this Law, the Government shall<br />
adopt the development strategy for the telecommunications sector, in accordance with<br />
this Law.<br />
Article 102<br />
The Agency shall be constituted within 15 days from the date of appointment of<br />
the Chairperson and members of the Agency.<br />
At its constitutive session, the Agency shall adopt the Statutes, the Rules of<br />
Procedure of the Managing Board of the Agency and the by-laws on the classification of<br />
positions and responsibilities and on the internal organization of the Agency.<br />
The Agency shall employ the necessary number of employees within 60 days of<br />
the by-laws from paragraph 2 of this Article coming into force.<br />
Article 103<br />
The Agency shall adopt the other by-laws that it is authorized to adopt under the<br />
present the Law within six months from the date of the constitution of the Managing<br />
Board.<br />
The regulations presently in force and, which are not in conflict with this Law<br />
shall remain in force until the by-laws from paragraph 1 of this Article have been<br />
adopted.<br />
