The Managing Board shall determine the amount of the fees and charges from<br />

paragraph 1 of this Article with the approval of the Government.<br />

The funds generated from one-time fee for obtaining the individual license shall<br />

be paid into the budget of the Republic of Serbia.<br />

For the first year, the funding of the Agency shall be provided as a short-term<br />

loan from the budgetary reserve in accordance with the law and based on a financial<br />

plan adopted by the Government, which shall also set out the time schedule for<br />

repayment of such funds to the budget from the revenues of the Agency.<br />

6. Transparency of Work of the Agency<br />

Agency Reports and Business Confidentiality<br />

Article 20<br />

The Agency shall prepare and submit to the Government and the National<br />

Assembly an annual report (including financial statements) on its activities, and in<br />

particular:<br />

1. report on the development of telecommunications in the Republic of Serbia;<br />

2. report on the implementation of tariff policy principles pertaining to regulated<br />

services;<br />

3. report on the progress in realization of universal service, including an assessment of<br />

the degree to which users’ needs have been satisfied; and<br />

4. report on the allocation and assignment of radio frequencies for civilian use.<br />

The Agency shall also make public, in the manner stipulated in the Statutes, the<br />

following:<br />

1. annual report (including financial statements) for each year;<br />

2. financial plan for each year;<br />

3. information pertaining to allocation and assignment of radio frequencies;<br />

4. information pertaining to public tenders for licenses, including the main terms and<br />

conditions of such public tenders;<br />

5. information about the licenses granted in accordance with this Law;<br />

6. decisions taken in accordance with this Law pertaining to the granted licenses and<br />

concluded interconnection contracts;<br />

7. information and/or decisions pertaining to special tariff regimes and/or tariff policy,<br />

including changes in tariffs for regulated services; and<br />

8. decisions taken in accordance with this Law pertaining to the Numbering Plan.<br />

Required Information<br />

Article 21<br />

At the request of the Agency, public telecommunications operators shall provide<br />

all data and information, including financial data and information, which are necessary<br />

for the performance of activities from within the responsibility of the Agency.<br />

The Agency shall treat all the information referred to in paragraph 1 of this Article<br />

as confidential, in accordance with the provisions of this Law and other regulations.<br />

Register Keeping<br />

Article 22<br />

The Agency shall create and maintain a database of its registers, which are<br />

public documents.<br />

The Agency shall keep the registers of:<br />

1. licenses granted to telecommunications operators;<br />

2. licenses granted for radio stations;<br />

3. technical licenses; and<br />

4. concluded interconnection contracts.<br />

The Agency shall also create and maintain a database of all its decisions,<br />

including complaints relating to those decisions, as well as any and other information of<br />

importance for the telecommunications sector.<br />

For public telecommunications operators whose headquarters are on the territory<br />

of the Autonomous Region of Vojvodina, all data that the Agency keeps according to<br />

the provisions of this Article, are also to be shown in the separate section of the<br />

Register.<br />

The decisions on rights or obligations of a public telecommunications operator<br />

or service user, or decisions imposing sanctions on a public telecommunications<br />
