consecutive months, or for a period of minimum six months with interruptions in the<br />
course of 12 months;<br />
5. it is established that during his/her term of office he/she has violated the rules on<br />
conflict of interest stipulated herein.<br />
Conflict of Interest<br />
Article 16<br />
The Chairperson and the members of the Managing Board, or any member of<br />
their families or next-of-kin in a direct line of kinship, irrespective of the degree of<br />
descent, or any relative on parents’ side inclusive of the second degree of descent, any<br />
spouse or an in-law inclusive of the first degree of descent, shall not, either directly or<br />
through a third party, have any equity interest, be it as a stakeholder, shareholder,<br />
employee, or person hired on contract or similar, in the companies and organizations<br />
which render telecommunications services, operate telecommunications networks, or<br />
provide telecommunications equipment, nor shall they be in any other way associated<br />
with such a company or organization.<br />
4. Statutes and Other By-laws<br />
Article 17<br />
The Managing Board shall adopt the Statutes of the Agency regulating in detail,<br />
inter alia, the internal organization and the procedure of the Agency.<br />
Pursuant to the Agency’s Statutes, the Managing Board shall adopt other bylaws<br />
including those governing the organization of the Agency departments, and the<br />
number and status of the Agency’s employees, as well as outsourcing of experts.<br />
The Statutes, the rules of procedure of the Managing Board, the by-law<br />
regulating the organization of Agency’s departments, and the decision appointing the<br />
Managing Board Deputy Chairperson shall be adopted, as a rule, by a majority vote of<br />
the total number of the Managing Board members.<br />
The regulations governing the salaries of employees in government authorities<br />
and public services shall not apply to the Managing Board Chairperson and the Agency<br />
employees.<br />
The Government shall approve the Statutes of the Agency.<br />
5. Financing of the Agency<br />

Article 18<br />
The Agency shall be financed in accordance with the financial plan adopted by<br />
the Managing Board for each year.<br />
The financial plan shall determine the total revenues and expenditures of the<br />
Agency, including the contingency reserves, and the elements of relevance for<br />
comprehensive review of earnings and employment policy of the Agency.<br />

The financial plan shall be adopted not later than 15th December of a current year<br />
for the following year.<br />
The total operating costs of the Agency covered by the financial plan, including<br />
the contingency reserves, may not exceed the actual expenditures of the Agency<br />
necessary for the successful performance of its duties.<br />
The financial plan from paragraph 1 of this Article shall be approved by the<br />
Government.<br />
The financial plan shall be published in the manner stipulated by the Statutes of<br />
the Agency.<br />
The Agency shall have all of its revenue and expenditure accounts audited<br />
annually by an authorized independent auditor. The audited accounts shall be published<br />
not later than three months after the end of the relevant fiscal year.<br />
Should the revenue and expenditure annual accounts of the Agency show a<br />
surplus of total revenues over the expenditures, such surplus shall be paid into the<br />
budget of the Government of the Republic of Serbia, and a part of such surplus, in<br />
proportion with revenues made by the public telecommunications operators which<br />
headquarters are on the territory of the Autonomous Region of Vojvodina, shall be paid<br />
into the budget of the Autonomous Region of Vojvodina, and shall be primarily used for<br />
telecommunications development.<br />
Sources of Financing<br />
Article 19<br />
The revenues of the Agency shall be the funds generated from the fees payable<br />
by public telecommunications operators for the right to build, own or operate public<br />
telecommunications networks or to provide public telecommunications services, for the<br />
use and assignment of radio frequencies, for issued certificates, as well as for costs of<br />
