Main Hearing in the Lawsuit over the Publication of a Correction
Article 63
No preliminary hearing shall be scheduled in lawsuits over the publication of a correction.
The court shall order the defendant to present a response to the charges within eight days upon delivery of the charges.
The first main hearing session shall be held within fifteen days upon reception of the response to the charges i.e. upon expiration of the
deadline for responding to the charges.
The court shall summon to the first session of the main hearing the plaintiff, the defendant and possibly the witnesses.
The summons to the plaintiff shall include notice that it shall be deemed that the charges have been dismissed in the event of the plaintiff's
absence from the first or any other subsequent main hearing session; the summons to the defendant shall include notice that, in the event of
his/her absence, judgment can be passed at the first main hearing session, and that in the event of his/her absence from the following hearing
sessions, the judgment shall be based on the facts established theretofore.
In lawsuits over the publication of a correction, no dormancy shall apply to the case.
Passing a Sentence and the Sentence
Article 64
The court shall pass and publicly pronounce the sentence immediately upon the conclusion of the main hearing.
