the right to exploit a telecommunications network or provide a telecommunications<br />
services under standard conditions (general authorization), or allowing the operator<br />
to build, own and exploit the telecommunications network or to provide<br />
telecommunications services in cases when the number of licenses is limited for a<br />
certain field (individual license), or allowing him to use a radio frequency and<br />
procure a radio station to operate on such frequency (radio station license), or to<br />
build and install a telecommunications network, system and/or equipment (technical<br />
license).<br />
Powers of Government Authorities in Telecommunications Sector<br />
Article 5<br />
In the telecommunications sector, upon the proposal of the ministry responsible<br />
for telecommunications (hereinafter Ministry), the Government of the Republic of<br />
Serbia (hereinafter Government), which has been prepared with participation of<br />
responsible authorities of the Autonomous Region, defines the policy and strategy of<br />
telecommunications development in the Republic and adopts the Radio Frequency<br />
Bands Allocation Plan<br />
Article 6<br />
The Ministry is authorized to:<br />
1. prepare a proposal of the strategy for telecommunications development in the<br />
Republic;<br />
2. take measures to promote research and development in the telecommunications<br />
sector in cooperation with the ministry in charge of the promotion and development<br />
of scientific research;<br />
3. prepare a proposal of the Radio Frequency Bands Allocation Plan and adopt the<br />
Radio Frequency Assignment Plan based on the proposal made by the Republic<br />
Telecommunications Agency;<br />
4. decide, in accordance with the Radio Frequency Allocation Plan, on the number and<br />
timing of individual licenses to be granted for public telecommunications networks<br />
or services for which, under this Law, a limited number of licenses may be granted<br />
as well as decide on the minimum conditions required for granting such licenses<br />
including the minimum amount of a one-time fee payable for each license granted;<br />
5. define the list of universal services to be provided by the operators of public fixed<br />
telecommunications networks, based on the proposal made by the Republic<br />
Telecommunications Agency;<br />
6. take measures in order to prevent cross-ownership or other forms of limited<br />
competition due to interrelation between telecommunications operators, which are in<br />
operation at the time when this Law has come into force, with the aim of eliminating<br />
and preventing monopolies and ensuring free competition in accordance with this<br />
Law;<br />
7. supervise the implementation of this Law and regulations adopted on the basis of<br />
this Law;<br />

8. implement the decisions and other acts of the Government relating to<br />
telecommunications networks, systems and equipment, in case of war or state of<br />
emergency.<br />
Proposals of acts referred to in Paragraph 1, points 1) and 3) of this Article, are<br />
prepared with participation of the responsible authorities of the Autonomous Region.<br />
II REPUBLIC TELECOMMUNICATIONS AGENCY<br />
1. Legal Status<br />

Article 7<br />
For the purpose of establishing conditions for efficient implementation and<br />
promotion of the telecommunications policy in the Republic of Serbia, the Republic<br />
Telecommunications Agency (hereinafter Agency) is hereby established as an<br />
autonomous and independent public organization exercising its authorities in<br />
accordance with this Law and regulations adopted on the basis of this Law.<br />
The Agency is an autonomous legal entity and is functionally independent of and<br />
not subordinated to any government authority, as well as of any organization and person<br />
engaged in operating telecommunications networks and equipment or providing<br />
services.<br />
In performance of the activities stipulated herein, the Agency shall ensure<br />
implementation of the development strategy adopted for the telecommunications sector<br />
in the Republic.<br />
