other telecommunications networks, systems and equipment.<br />

Telecommunications networks, systems and equipment may be put into<br />

operation only after the Agency has completed technical inspection, including the<br />

examination of the parameters specified in the project and/or technical documentation<br />

on the basis of which the license has been granted. The Agency shall specify the<br />

technical inspection procedure.<br />

If technically or otherwise feasible, the Agency may order sharing of<br />

infrastructure by two or more telecommunications operators, in other words, it may<br />

order a telecommunications operator – infrastructure owner - to enable another<br />

telecommunications operator to share its infrastructure in return for fair compensation.<br />

Public telecommunications operators are entitled to request the rights of way<br />

over or the right to use the land owned by another person (easement) if this is necessary<br />

for establishment of the public telecommunications networks or systems and installation<br />

of telecommunications equipment.<br />

If a public telecommunications operator and the property owner are unable to<br />

reach an agreement on the right of way or easements for the purpose of installation or<br />

protection of telecommunications networks, systems and equipment, the right of access<br />

or the right of way shall be regulated under general rules by the Agency.<br />

When constructing or installing telecommunications networks, systems and<br />

equipment, a telecommunications operator is under an obligation to take the necessary<br />

measures to protect the property of the owners and the safety and health of people and<br />

to ensure the safe flow of vehicular traffic and the protection of the environment,<br />

particularly with regard to radiation that is deemed harmful under the applicable<br />

standards.<br />

Works in the Vicinity of Telecommunications Facilities<br />

Article 88<br />

It is prohibited to perform works near telecommunications facilities and other<br />

telecommunications equipment or build facilities that may affect or interfere with their<br />

operation.<br />

If it is necessary to perform such works or build such facilities, the investor<br />

and/or the contractor shall obtain the prior approval of the telecommunications operator<br />

so to ensure that the necessary measures have been taken for protection and smooth<br />

operation of the telecommunications facilities.<br />

The costs of taking the measures and obtaining the approval from paragraph 2 of<br />

this Article shall be borne by the investor and/or the contractor.<br />

Radio Corridors and Safety Zone<br />

Article 89<br />

Available radio relay links (radio corridors) in towns and urban settlements shall<br />

be specified in urban development plans.<br />

Tin the vicinity of radio stations and antenna systems and along the radio path<br />

between two radio stations there shall be a safety zone in which it is prohibited to build<br />

other radio stations, facilities or installations that may obstruct the propagation of radio<br />

waves or cause interference.<br />

Power Installations<br />

Article 90<br />

Power installations for transmission, distribution or utilization of electric energy,<br />

which are located near a telecommunications network, must be built, used and<br />

maintained so as to avoid interference in the operation of that telecommunications<br />

network and to avoid endangering the life and health of people who perform works on<br />

or operate that telecommunications network.<br />

Electromagnetic Interference<br />

Article 91<br />

Power installations and other equipment and devices must not cause<br />

electromagnetic interference to the telecommunications networks and must have a<br />

certificate that certifies that they comply with the measures for prevention of<br />

electromagnetic interference in the operation of the telecommunications network and<br />

reception of signals.<br />
