company or other entity that is to be subject to inspection of their visit for the purpose<br />

of conducting inspection.<br />

Upon the receipt of the notification from paragraph 1 of this Article,<br />

telecommunications operators, radio station license holders, and/or owners or occupants<br />

of the facilities in which telecommunications networks, systems or equipment are<br />

located or in which telecommunications equipment is manufactured, are obliged to<br />

provide the telecommunications inspectors with access to such facilities, and provide<br />

them, without delay, with the requested information and documentation pertaining to<br />

the telecommunications networks, systems, facilities or equipment which are under<br />

inspection, and to enable the inspectors to complete necessary tests and measurements,<br />

or to complete such tests and measurements by themselves at their request.<br />

Radio station license holders are obliged to comply with the summons from<br />

telecommunications inspectors or radio-emission controllers for the purpose of special<br />

tests on their radio stations or measurements of radio emission to be performed in<br />

monitoring and measuring centers.<br />

Rules of Procedure<br />

Article 30<br />

The provisions of the law regulating the general administrative procedure shall<br />

apply to the procedure of the supervision and enforcement referred to in Article 24<br />

hereof.<br />

Monitoring and Measuring Centers<br />

Article 31<br />

For the purpose of performing specific supervision activities, and the control of<br />

radio emission in particular, the Agency may establish monitoring and measuring<br />

centers, as its organizational units outside its head office (regional units), in accordance<br />

with the Statutes.<br />

In addition to the supervision and enforcement activities stipulated herein, upon<br />

the request of telecommunications operators or other persons, monitoring and<br />

measuring centers may:<br />

1) test radio stations in order to check their compliance with the conditions and<br />

requirements stipulated under this Law and the regulations adopted on the basis of<br />

this Law;<br />

2) test transmitters, receivers, antennas, and other equipment which are part of radio<br />

stations in order to examine the compliance of their technical characteristics with<br />

national and international norms and standards in the field of radio communications;<br />

3) perform other tests and measurements in the field of radio communications for the<br />

purpose of planning and designing of new radio systems and radio networks, and<br />

selection of adequate radio frequencies for such systems and networks.<br />

The fees for the tests and measurements referred to in items 1) and 2), paragraph<br />

3 of this Article shall be payable in accordance with the price list adopted by the<br />

Agency.<br />

III. LICENSES FOR PUBLIC TELECOMMUNICATIONS NETWORKS AND<br />

PUBLIC TELECOMMUNICATIONS SERVICES<br />

Licensing Principles<br />

Article 32<br />

Any physical or legal person may construct, own or operate a public<br />

telecommunications network and/or provide public telecommunications service, if the<br />

Agency has previously granted him/her the relevant license, unless otherwise stipulated<br />

by this Law.<br />

Any legal or physical person who meets the terms and conditions stipulated in<br />

this Law and regulations adopted on the basis of this Law, including the by-laws of the<br />

Agency and the technical requirements and standards referred to in those regulations,<br />

shall be entitled to obtain a license under the same terms and conditions.<br />

The licensing procedure shall be transparent, and the relevant registers of the<br />

granted licenses shall be kept in accordance with this Law.<br />

Types of Licenses<br />

Article 33<br />

The Agency shall grant licenses for public telecommunications network and<br />

public telecommunications services, radio station licenses and technical licenses.<br />

The licenses for public telecommunications networks and public<br />

telecommunications services are an individual license and a general authorization.<br />

By obtaining a license from paragraph 2 of this Article, its holder acquires the<br />

right to perform a specific telecommunications activity.<br />
