competence.<br />
However, while it is commonly accepted that the audit reports were submitted in a good quality and a<br />
timely manner, their publication seems to have been delayed due to Government interference. Some<br />
members of parliament have expressed concerns that audit reports might have been “corrected” after<br />
Government intervention during the period between submission and publication of reports. There are<br />
also some reports in the media, that on some occasions the Auditor-General was put under pressure by<br />
the Government to soften his findings in audit reports by declaring publicly that the findings “were not<br />
that bad” to minimize their impact. There were some concerns raised that deputy Auditor-Generals may<br />
have been selected for appointment under political influence, which may have a negative impact on the<br />
operations of the Auditor-General. Additional Government interferences in the functioning of the<br />
Auditor-General are manifested by the fact that the Government did not release funds allocated to the<br />
Auditor-General until November 2009, which made it difficult for the Auditor-General to audit the<br />
annual budget of 2008-2009 The Auditor-General is also located in premises, which do not provide the<br />
necessary office space to host all his employees, which puts additional constraints on their<br />
functioning. 435<br />
These circumstances indicate that the Auditor-General will face significant challenges when auditing<br />
Kosovo’s security institutions, especially in the phases of their initial development when many public<br />
procurement activities will be required to make them operational. Lack of Government support and<br />
adequate follow-up in the Assembly of Kosovo may tempt the security institutions to ignore the audit<br />
reports prepared by the Auditor-General, unless there is a sanctions mechanism in place which will<br />
provide the necessary incentives for compliance.<br />

The Anti-Corruption Agency (henceforth the “Agency”) is established as an independent institution,<br />
responsible for implementing public policies on combating and preventing corruption in Kosovo. 436 As<br />
an independent institution, it is protected by the Constitution, which guarantees that it can exercise its<br />
