deal with the emergency. 345 It is evident, that in exercising such executive authority, the Kosovo Security<br />

Council might also possibly violate human rights or abuse its authority. The Law establishing the<br />

Kosovo Security Council provides no legal remedies against such actions by the Kosovo Security<br />

Council. Nevertheless, complaints about such actions fall under the jurisdiction of the Ombudsperson. 346<br />

Practice<br />

In its Annual <strong>Report</strong> 2007-2008, the Ombudsperson has reported 35 cases of complaints filed against the<br />

Kosovo Police, 347 while between 2008 and 2010 a further 8 complaints have been filed. 348 Only one<br />

complaint has so far been filed against the Kosovo Security Force 349 , while so far there are no complaints<br />

against the Kosovo Intelligence Agency, which has recently been established and whose operational<br />

capacities are still very limited. The complaints filed against the Kosovo Police primarily concerned<br />

alleged excessive use of force by police officers 350 , abuse and maltreatment by police officers 351 and also a<br />

case of domestic violence allegedly committed by a police officer 352 . There were also complaints filed by<br />

persons, who had applied for a position with the Kosovo Police and were rejected. 353 Complaints were<br />

filed by members of the <strong>Alb</strong>anian and other communities. 354<br />

The general perception of the Ombudsperson is that the investigations conducted by the Police<br />

Inspectorate are not that clear, and some complaints were dismissed because of lack of evidence. The<br />

Ombudsperson also questions the impartiality of the investigations, as they were conducted by an<br />

institution, which is under the authority of the Ministry of Internal Affairs, which has also authority<br />

over the Kosovo Police. There was also no evidence that the interventions and recommendations made<br />

by the Ombudsperson have been complied with.<br />
