(M.P. 1224/16.)No. 443.NOTICE.<strong>THE</strong> IRRIGATION AND WATER LAW, 1887.WHEREAS pursuant to the provisions of theIrrigation and Water Law, 1887, the Commissionerof Limassol held, on the 20th day of March,1918, a public meeting; of the proprietors of land inthe village of Kapilio for the formation of anIrrigation Division and the protection of the watercourses and channels from the Xilourikos riverconnected with the irrigation of the lands of thevillage of Kapilio in the District of Limassol:AND WHEREAS it was determined at the saidmeeting that an Irrigation Division should be formed,and a Committee composed of Messrs. NearkhosI. Papapetrou, Georgios Papa Christodoulou, andStavrinos Michael, all of KapiUo, was elected for thepurpose of drawing up Rules for the purposesaforesaid:AND WHEREAS the said Committee has, togetherwith and under the presidency of the Commissioner ofLimassol, drawn up accordingly the Rules in theSchedule hereto :Now <strong>THE</strong>REFORE, Notice is hereby given that anyperson having any objection to the said Rules is requestedto state his objections in writing to the ChiefSecretary to the Government or to the Commissionerof Limassol within one month from the date hereof.<strong>THE</strong> SCHEDULE ABOVE REFERRED TO.KAPILIO IRRIGATION WORKS.Rules draum up by the Committee under Law XI.of 1887, for the protection and repair of WaterCourses and Channels connected with the Irrigationof the Lands of Kapilio.1. Every owner of land entitled to irrigation fromthe Xilourikos river shall pay a rate of 7cp. per annumfor every donum of land irrigated by him, and allrates paid under this rule shall be utilised to defraythe expenses connected with the Kapilio IrrigationWorks.2. The said rate shall be paid as follows : one-halfon or before the 1st July and the other half by the1st September in each year.3. The assessment will be based on a list of theproprietors of land showing the names of the proprietorswho will be benefited by the KapiUo IrrigationWorks, and the number of donums possessed by each,subject always to any changes of ownership which mayoccur from time to time and which will be notifiedto the Commissioner by the Irrigation Committee.Early in each year a copy of the said list signed bythe Irrigation Committee shall be posted at a conspicuousplace in the vUlage, and a certified copythereof shall be lodged with the Commissioner ofLimassol.4. All rates levied under these rules shall form afund to be called the " KapiUo Water Fund " whichshaU be administered by the Irrigation Committee,one member whereof shall be appointed Cashier.5. The Cashier shaU keep a careful account of allmoneys collected and expended.6. If the Irrigation Committee find that the rate o^7cp. per donum is insufficient to cover the expensesof the year, they are hereby authorised to levy onemore piastre per donum from each proprietor on thelist, provided the sum levied shall not exceed 8piastres per donum. Provided always that in theevent of the accounts at any time showing a surplusrevenue, the Irrigation Committee shall be at libertyto reduce the assessment imposed under rule 1 by suchamount as they may deem practicable.7. If the Irrigation Committee report in writing tothe Commissioner that a proprietor has neglected topay his rates under rule 2, such proprietor, as long ashe shall continue in default, shall be precluded fromtaking water from the Kapilio Irrigation Works. If hepersists, by fraud or force, in taking water he shall beprosecuted by the said Committee under Section 86 ofLaw XI. of 1887.8. The owners of the two Water Mills calledKouroushi and Panayia tou Kyccou and situatedwithin the area of the Kapilio Irrigation Works shall,in addition to any payments due under rule 1, payyearly 10/- for each mill in respect of the water towhich they are entitled.9. The Irrigation Committee shaU appoint a guardwith pay at a rate not exceeding 25/- a month, for suchmonths as the said Committee shall think necessary.10. Once in each year at Easter-time the dams andchannels shall be thoroughly repaired by the Waterproprietors, all other repairs shall be paid from theKapilio Water Fund. The main channel and dams ofthe mills above stated shall be maintained in goodcondition by the two Mill-owners.11. Any'person damaging or destroying any furrow,channel or dam shall make good the damage within atime to be fixed by the Committee.12. No person shall enlarge or lessen the width orany branch or channel or open a new channel or interferein any way with the works without the leave inwriting signed by the Irrigation Committee, and noleave shall be given under this rule until 10 days aftera notice has been posted in the Village of KapiUo sothat any complaints against the application may beenquired into by the said Committee and the Commissioner.13. No one shall be allowed to cut the water eitherwith a view of obtaining more water for his ownfields or for any other purpose.14. Every person upon whom a notice for thatpurpose has been served by the Commissioner or theIrrigation Committee shall, at once, clean such part ofthe channel as runs through his fields of any stones orrubbish which might divert the water or stop itsproper course, and shall remove all stones and otherthings intended to direct the water on to his field atthe proper time.15. Any Court or other expenses necessary for theprosecution of offenders shall be paid from the fundscollected under these rules.16. The mode of making sluices shall be as theIrrigation Committee may indicate.17. The Irrigation Committee shall hold office fortwo years and a new Committee shall be elected at ameeting to be held every two years by the proprietors^interested.18. Two members of the Irrigation Committee withthe Commissioner shall form a quorum. If all fourmembers present are equally divided on any questionthe Commissioner as President shall have a castingvote.19. A statement of Receipts and Expenditure underthese rules shall be furnished by the Irrigation Committeeto the Commissioner and a copy shall be postedin the VUlage of KapiUo between June 15th and SOthof each year.6th September, 1918.
