280 <strong>THE</strong> <strong>CYPRUS</strong> <strong>GAZETTE</strong>, 1st NOVEMBER, 1918.Water Law, 1887, do hereby notify and proclaim thatthe said Rules have been considered and approved byme in Council and are set forth in the Schedule hereto.Given at Nicosia, this 28th day of October, 1918.GOD SAYE <strong>THE</strong> KING.<strong>THE</strong> SCHEDULE ABOVE REFERRED TO.1. Every owner of land entitled to irrigation fromthe Diorisos river shaU pay a rate of 18c;?. per annumfor every donum of land irrigated by him, and allrates paid under this rule shall be utilised to defraythe expenses connected with the Phini Irrigation Works.2. The said rate shall be paid as follows : one-halfon or before the 1st July and the other half by theIst September in each year.3. The assessment will be based on a list of theproprietors of land showing the names of the proprietorswho will be benefited by the Phini IrrigationWorks, and the number of donums possessed by each,subject always to any changes of ownership which mayoccur from time to time and which will be notifiedto the Commissioner by the Irrigation Committee.Early in each year a copy of the said list signed bythe Irrigation Committee shall be posted at a conspicuousplace in the village, and a certified copythereof shall be lodged with the Commissioner ofLimassol.4. All rates levied under these rules shall form afund to be called the "Phini Water Fund" whichshall be administered by the Irrigation Committee,one member whereof shall be appointed Cashier.5. The Cashier shall keep careful account of allmoneys collected and expended.G. If the Irrigation Committee find that the rate of18cjo. per donum is insufficient to cover the expensesof the year, they are hereby authorised to levy onemore piastre per donum from each proprietor on thelist, provided the sum levied shall not exceed 19piastres per donum. Provided always that, in theevent of tli'j accounts at any time showing a surplusrevenue, tlie Irrigation Comriiittee shall be at libertyto I'erluce the assessment iviiposfd under rule 1 by suchamount as they may (h cm practicable.7. If c'le iri'ipition Committee report in writing tothe Ccnumissioner that a proprietor has neglected topay his rates under rule 2, sucli proprietor, as long ashe shall continue in defiiult, shall be precluded fromtaking water from the Phini Irrigation Works. If hepersists, by fraud or force, in taking water he shall beprosecuted by the said Committee under Section 36 ofLaw XI. of 1H87.H. The owners of the three Water Mills situatedwithin the area of the Phini Irrigation Works sballpay as foUows :—£ s.The Mill of Trooditissa Monastery... 1 10 yearly.The MiU of PhUippo 1 0 „The MiU of Kroko 10 „for the water to which they are entitled, in additionto any payments due under rule 1.9. The Irrigation Committee shall appoint threeguards with pay at a rate not exceeding £2 a month,for such months as the said Committee shaU thinknecessary.10. Once a year in the month of March all theWater Proprietors shall a.>sist in repairing the waterfurrows. Any further re; airs shali be jiaid for fromthe Phini Water Fund.11. Any person damaging or destroying any furrow,channel or dam shall make good the damage within atime to be fixed by the Committee.12. No perBon shall enlarge or lessen the width ofany branch or canal or open any new channel or interferein any way with the works without the leave inwriting signed by the Irrigation Committee, and noleave shall be given nnder this rule until 10 days aftera notice has been posted in the village of Phini sothat any complaints against the application may beenquired into by the said Committee and the (Commissioner.13. No one shaU be allowed to cut the water eitherwith a view of obtaining more water for his ownfields or for any other purpose whatever.14. Every person upon whom a notice for thatpurpose has been served by the Commissioner or theIrrigation Committee shall, at once, clean such part ofthe channel as runs through his fields of any stones orrubbish which might divert the water or stop itsproper course, and shall remove all stones and otherthings intended to direct the water on to his field atthe proper time.15. Any Court or other expenses necessary for theprosecution of offenders shall be paid from t!ie fundscollected under these rules.16. The mode of making sluices shall be as theIrrigation Committee may indicate.17. The Mill dams and streams from them to theMills shall be kept in repair by the Mill owners.18. The Irrigation Committee shall hold office fortwo years and a new Committee shall be elected at ameeting of proprietors interested, to be held every twoyears, if possible during the Easter Week.19. Two members of the Irrigation Committee withthe Commissioner shall form a quorum. If all fourmembers present are equally divided on any question,the Commissioner as President shall have a castingvote.20.
