LEE UNIVERSITY FACULTY HANDBOOK & CONSTITUTIONIX. Policy AdministrationA. Intellectual Property Review Board1. The Intellectual Property Review Board (“Board”) is an advisory body,reporting directly to the Vice President for Academic Affairs.2. The Board members shall be appointed as needed by the Vice President forAcademic Affairs with recommendations from the Deans Council. The Boardmembers shall include a representative from the Business and Finance sectorand a representative from the Information Services sector. The remainingmembers will include at least 4 faculty members.3. In addition to duties described elsewhere in this Policy, the Board shall advisethe Vice President for Academic Affairs by a) interpreting the terms of thisPolicy; and b) recommending changes or exceptions to this Policy.X. Dispute ResolutionThe inventor(s) can request to resolve any dispute with the university. The firstappeal must be made to the VP for Academic Affairs. The Vice President forAcademic Affairs shall attempt to resolve any claim, dispute or controversy involvingthe rights to Inventions or copyrighted works within 2 weeks of the date of appeal bythe inventor(s). Upon the failure of the involved parties to reach a negotiatedagreement, the Vice President for Academic Affairs shall refer the matter to theIntellectual Property Review Board.The Intellectual Property Review Board shall review all documents and recordsand hear testimony from all interested parties and attempt to resolve any claim within4 weeks of the original date of appeal of the inventor(s) to the VP for AcademicAffairs. Upon the failure of the involved parties to reach a negotiated agreement, thematter will be referred for mediation.The choice of a neutral mediator is to be agreed upon by both parties. Mediationshall begin no later than 8 weeks from the original date of the appeal of theinventor(s) to the Vice President for Academic Affairs.XI. Student Research and Scholarship<strong>University</strong> students are subject to this Policy when they participate in facultyresearch programs. A student is an employee within the meaning of this policy.Intellectual Property created by a student during such employment or course of studyshall be owned by the entity so designated in the SRA, or if no entity is sodesignated, by the <strong>University</strong>. Thus, in circumstances where a student originatesIntellectual Property independently, using resources generally available to students,and without faculty supervision, such Intellectual Property is owned by the student.A. Student Research in the Sciences.In the disciplines of Chemistry, Biology, Physics, and Mathematics, andComputer Science, and Health Sciences, the model for faculty direction ofundergraduate student research is that of master/apprentice. In this setting, allInventions, Courseware, and copyrightable works by students originate primarilyfrom faculty direction of the master/apprentice relationship and are owned by the<strong>University</strong> under the terms described in sections III. and IV. above.1. <strong>Faculty</strong> who supervise undergraduate student research have custody andcontrol over all Tangible Research Property (TRP) (See V., TangibleResearch Property), subject to the terms of any grant or SRA.
