MAY 2009SOLICITATION FOR OFFERS OUTPATIENT CLINIC <strong>SFO</strong> NO. VA-101-XX-RP-XXXX[INSERT LOCATION OF FACILITY]3.15 APPURTENANT AREASThe right to use appurtenant areas and facilities is included. The Government reserves theright to post Government rules and regulations where the Government leases space.3.16 VENDING FACILITIESVA is required to comply with the provisions <strong>of</strong> the Randolph-Sheppard Act pertaining toVending Facility Programs for the Blind, 34 CFR 395, on properties owned, leased, oroccupied by the Government. VA will have notified the appropriate State licensing agency <strong>of</strong>intent to occupy space under this lease. The State licensing agency shall be afforded theopportunity to determine whether the building includes a satisfactory site for a vending facilityand, subject to the approval by VA, shall be <strong>of</strong>fered the opportunity to select the location andtype <strong>of</strong> vending facility to be operated by a blind vendor prior to the completion <strong>of</strong> the finalspace layout.The Lessor will have no right to control or receive income from automatic vending machineslocated in the vending facility <strong>of</strong> the leased premises. // If space is <strong>of</strong>fered in existing buildingswith vending facilities established under pre-existing agreements, VA will ensure that thefacility does not compete with other facilities having exclusive rights in the building. Offerorsmust advise VA if such rights exist.//3.17 DESIGN AND CONSTRUCTION DOCUMENTS AFTER AWARDDesign development after award shall be in accordance with the requirements <strong>of</strong> thisSolicitation, and shall be a direct extension <strong>of</strong> the submitted design concept. The designdevelopment shall retain all the functional and basic physical characteristics <strong>of</strong> that concept.The Contracting <strong>Office</strong>r shall have the right to reject any aspect <strong>of</strong> subsequent design thatvaries from the concept and would adversely affect the Government's use and occupancy <strong>of</strong>the space or the Government's other interests in the building as set forth or implied in thisSolicitation. Nonetheless, the Offeror may propose for the Contracting <strong>Office</strong>r's acceptance,or the Contracting <strong>Office</strong>r may propose for the Offeror's acceptance, evolutionary adaptationsor changes to the concept, that improve the design. Neither party will unreasonably withholdsuch acceptance <strong>of</strong> demonstrated beneficial design adaptations <strong>of</strong> the concept which wouldnot measurably increase the costs <strong>of</strong> construction, operation, or occupancy <strong>of</strong> the space orbuilding and which would not decrease the utility <strong>of</strong> the space or building to either party.Changes to planned design layout do not constitute a change for cost.3.17.1 RESPONSIBILITIES OF LESSOR’S DESIGN TEAMThe Lessor’s design team (A/E) shall be responsible for producing a complete set <strong>of</strong> drawings,design narrative/analysis, calculations, sample boards, and specifications in accordance withpr<strong>of</strong>essional standard practices and the criteria contained in this <strong>SFO</strong>. Drawings and relateddata shall be prepared in accordance with the National CAD Standard (NCS) published by theNational Institute <strong>of</strong> Building Sciences (NIBS) as amended by the VHA National CAD StandardApplication Guide with regard to conventions in layer names, drawing organization, andplotting. Each A/E discipline shall receive a copy <strong>of</strong> VHA National CAD Standard ApplicationGuide.
