VA buildingsmust meet the requirements of NFPA 101 and documents referenced by NFPA 101 in order tocomply with the accreditation requirements of the Joint Commission. Therefore, designs shallcomply with the requirements of NFPA 101 and documents referenced therein. Mandatory Provisions for Energy ConservationFederally mandated statutory requirements for energy conservation are also applicable to theleased facilities. These requirements include:(1) Federal Leadership in High Performance and Sustainable Buildings: MOU(Memorandum of Understanding) Dated November 2006This document was signed by 21 Federal Agencies under the Federal Leadership in HighPerformance and Sustainable Buildings. The stated goals and objectives of the MOU are:New Construction: Reduction in the Energy Cost Budget by 30% over the Baselineperformance rating of ASHRAE Standard 90.1 – 2004.Reduction in the energy cost budget shall be implemented as the reduction in energyconsumption measured as BTU (British Thermal Units) or Joules (J).For major renovations, reduce the energy cost budget by 20% below pre-renovations 2003baseline. In the event pre-renovation 2003 baseline data is not available, the A/E shallcalculate the energy consumption before renovation, compare it with the energy consumptionafter renovation, and document the mandated saving. It is assumed that the use of the facilityshall remain similar before and after the renovation. The term "major renovation" shall meetthe following two guidelines: Area of renovation is greater than 50% of the total area. A project is planned that significantly extends the building's useful life throughalterations or repairs and totals more than 30% of the replacement value of the facility.Additional issues addressed by MOU are:Commissioning: For the leased facilities, commissioning of the mechanical and otherbuilding systems shall be implemented to verify the intent of the design by inspecting andtesting the systems.Measurements and Verification: Per DOE Guidelines issued under section 103 of theEnergy Policy Act of 2005 (EPAct), install building level utility meters in new majorconstruction and renovation projects to track and continuously optimize performance. MOUmandates that the actual performance data from the first year of operation should becompared with the energy design target. After one year of occupancy, measure all new majorinstallations using the Energy Star® Benchmarking Tool for building and space types coveredby ENERGY STAR® or FEMP-designated equipment.(2) Energy Policy Act (2005):DOE issued mandatory energy conservation guidelines as the final rule for implementingprovisions of EPAct 2005.(3) Executive Order 13423: Strengthening Federal Environmental, Energy, andTransportation ManagementMandatory energy conservation guidelines are also reiterated in the above Executive OrderDOE has mandated that a new Federal building must be designed to achieve an energyconsumption level that is at least 30% below the level achieved under Standard 90.1-2004, iflife-cycle cost-effective.Part I: Basic Solicitation Requirements – Page 53 of 196Lessor __________ Gov’t. ____________________ of __________ Pages
