the condition of the ditches is recorded as affected by modern‐day activities. Although there are<br />

OHV crossings on the ditches, the ditches remain in fair condition and retain some historic<br />

integrity as interpretive elements of the landscape. The ditches lack a significant association, these<br />

types of ditches are ubiquitous, and the integrity of the ditches has been compromised. A<br />

Determination of Eligibility Statement was prepared for the State Historic Preservation <strong>Off</strong>icer<br />

(SHPO) and submitted on June 16, 2010. SHPO concurred that this resource was not eligible as a<br />

historical resource defined by PRC 5020.1[j].<br />

The archaeological survey also resulted in the documentation of three resources (a culvert<br />

concentration, a historic refuse pile, and a wire cable concentration) that are associated with the<br />

excavation of the basin for the construction of the Lake Oroville Dam. These artifacts date from<br />

1964 and will not become potentially significant cultural resources until they are 50 years old (in<br />

2014). This potential would occur within the lifetime of the General Plan so these potential<br />

resources were included in the June 16, 2010 Determination of Eligibility Statement for SHPO. It<br />

was decided by SHPO, that the 1964‐era resources are not considered eligible as historical<br />

resources defined by PRC 5020.1[j].<br />

3.6.2 Regulatory Setting<br />

State and regional plans, policies, regulations, and laws related to cultural resources at Clay Pit<br />

SVRA are summarized below. Additional regulatory information related to cultural resources can<br />

be found in Section 2.7.3, “Regulatory Influences,” of the Clay Pit SVRA General Plan, including a<br />

summary of Section 106 of the National Historic Preservation Act, the <strong>California</strong> Register of<br />

Historical Resources, PRC Section 15064.5(e) of the State CEQA Guidelines, and PRC 5024.<br />
