3.6 Cultural Resources<br />

items by publicly funded agencies and museums in <strong>California</strong>. The policy provides for mechanisms<br />

to aid <strong>California</strong> Indian tribes, including nonfederally recognized tribes, in filing repatriation<br />

claims and getting responses to those claims.<br />

Native American Consultation<br />

Government Code Section 65352.3 (Senate Bill 18) requires local governments to consult with<br />

<strong>California</strong> Native American tribes identified by the <strong>California</strong> NAHC before adopting or amending a<br />

general plan or specific plan. Senate Bill 18 requires that this consultation take place on a<br />

government‐to‐government level. State Parks issued Departmental Notice No 2007‐05 in 2007.<br />

The notice sets forth State Parks’ policy for consultation with Native <strong>California</strong> Indians regarding<br />

activities that affect matters relating to their heritage, sacred sites, and cultural traditions. General<br />

plans are included in the list of potential activities.<br />

Consultation with the Native American community for Clay Pit SVRA was initiated by State Parks<br />

OHMVR Division with a letter to the NAHC requesting a search of the Sacred Land Files and a list<br />

of appropriate Native American tribal contacts for individual consultation. Contact letters were<br />

sent to the following organizations:<br />

Berry Creek Rancheria of Maidu Indians,<br />

Butte Tribal Council,<br />

Maidu Cultural and Development Group,<br />

Greenville Rancheria of Maidu Indians,<br />

Mechoopda Indian Tribe of Chico Rancheria,<br />

Enterprise Rancheria of Maidu Indians, and<br />

Mooretown Rancheria.<br />

No written responses to the consultation letters were received by State Parks. Follow‐up phone<br />

calls were also made, but no responses or concerns have been provided to State Parks regarding<br />

cultural resources situated within or near Clay Pit SVRA.<br />

3.6.3 Thresholds of Significance<br />

The significance criteria for this analysis are based on the environmental checklist in Appendix G<br />

of the State CEQA Guidelines, as amended. Implementation of the Clay Pit SVRA General Plan,<br />

including construction and operation of the headquarters facilities, would have significant<br />

environmental impacts related to cultural resources if it would:<br />

cause a substantial adverse change in the significance of a historical resource as defined in<br />

Section 15064.5 of the State CEQA Guidelines;<br />

cause a substantial adverse change in the significance of an archaeological resource<br />

pursuant to Section 15064.5 of the State CEQA Guidelines;<br />

Clay Pit State Vehicular Recreation Area<br />
