Certa<strong>in</strong>lychang<strong>in</strong>g state law is an important means<strong>of</strong> strengthen<strong>in</strong>g women’s property rights. Insome cases this <strong>in</strong>volves repeal <strong>of</strong> discrim<strong>in</strong>atorylaws, such as those <strong>of</strong> Lesotho andSwaziland that declare women to be legalm<strong>in</strong>ors, and therefore unable to hold property.Other legal mechanisms to strengthenwomen’s property rights <strong>in</strong>clude reform<strong>of</strong> <strong>in</strong>heritance laws or provision for jo<strong>in</strong>ttitl<strong>in</strong>g <strong>of</strong> land <strong>in</strong> the names <strong>of</strong> husband andwife that can provide women with strongerclaims on the land while their husbands areliv<strong>in</strong>g, and greater security <strong>in</strong> the case <strong>of</strong>widowhood or divorce. While much <strong>of</strong> theattention on legal reforms has focused onprivate lands, strengthen<strong>in</strong>g recognition <strong>of</strong>rights over public or common lands – and<strong>in</strong> many cases, prevent<strong>in</strong>g privatization<strong>of</strong> the common resources that many poorwomen depend upon – can be an equallyimportant mechanism for secur<strong>in</strong>g women’saccess to resources.However, legal changes do not automaticallytranslate <strong>in</strong>to changes on the ground.For new property rights laws to becomeeffective, both the implementers <strong>of</strong> thelaw and the public need to be aware <strong>of</strong>
