A copy <str<strong>on</strong>g>of</str<strong>on</strong>g> the certificate must also <str<strong>on</strong>g>be</str<strong>on</strong>g> provided <str<strong>on</strong>g>to</str<strong>on</strong>g> Council, attenti<strong>on</strong> Development Engineer,<br />

prior <str<strong>on</strong>g>to</str<strong>on</strong>g> issue <str<strong>on</strong>g>of</str<strong>on</strong>g> any Final Certificate.<br />

128. Prior <str<strong>on</strong>g>to</str<strong>on</strong>g> occupati<strong>on</strong>, issue <str<strong>on</strong>g>of</str<strong>on</strong>g> an Occupati<strong>on</strong> Certificate or issue <str<strong>on</strong>g>of</str<strong>on</strong>g> the Final Compliance<br />

Certificate (and at the completi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> works), the applicant shall <str<strong>on</strong>g>to</str<strong>on</strong>g> the Principal Certifying<br />

Authority (PCA) certificati<strong>on</strong> from a registered surveyor that no structures are located over the<br />

existing drainage pipeline and/or easement traversing the subject property. A copy <str<strong>on</strong>g>of</str<strong>on</strong>g> the<br />

certificati<strong>on</strong> must also <str<strong>on</strong>g>be</str<strong>on</strong>g> provided <str<strong>on</strong>g>to</str<strong>on</strong>g> Council, attenti<strong>on</strong> Development Engineer, prior <str<strong>on</strong>g>to</str<strong>on</strong>g> issue<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> any Final Certificate.<br />

129. Prior <str<strong>on</strong>g>to</str<strong>on</strong>g> issue <str<strong>on</strong>g>of</str<strong>on</strong>g> the Occupati<strong>on</strong> Certificate a maintenance regime shall <str<strong>on</strong>g>be</str<strong>on</strong>g> prepared for the<br />

basement s<str<strong>on</strong>g>to</str<strong>on</strong>g>rmwater pump-out system and submitted <str<strong>on</strong>g>to</str<strong>on</strong>g> Principal Certifying Authority. The<br />

regime shall specify that the system is <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g> regularly inspected and checked by qualified<br />

practiti<strong>on</strong>ers.<br />

130. Prior <str<strong>on</strong>g>to</str<strong>on</strong>g> issue <str<strong>on</strong>g>of</str<strong>on</strong>g> the Occupati<strong>on</strong> Certificate a suitably qualified and c<strong>on</strong>sulting geotechnical<br />

engineer is <str<strong>on</strong>g>to</str<strong>on</strong>g> provide certificati<strong>on</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g> the Principal Certifying Authority that excavati<strong>on</strong> and<br />

c<strong>on</strong>structi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the basement level, including temporary and permanent shoring and retenti<strong>on</strong><br />

measures, have <str<strong>on</strong>g>be</str<strong>on</strong>g>en carried out :<br />

a) According the relevant Australian Standards and guidelines, and<br />

b) According <str<strong>on</strong>g>to</str<strong>on</strong>g> any approved Geotechnical report undertaken for the development, and<br />

c) In a manner that ensures that the structural amenity <str<strong>on</strong>g>of</str<strong>on</strong>g> adjoining structures and property<br />

is fully maintained.<br />

131. Prior <str<strong>on</strong>g>to</str<strong>on</strong>g> issue <str<strong>on</strong>g>of</str<strong>on</strong>g> the Occupati<strong>on</strong> Certificate, a complete record <str<strong>on</strong>g>of</str<strong>on</strong>g> geotechnical inspecti<strong>on</strong>s,<br />

testing and m<strong>on</strong>i<str<strong>on</strong>g>to</str<strong>on</strong>g>ring with certificati<strong>on</strong>s as specified in the Report <strong>on</strong> Geotechncal<br />

Investigati<strong>on</strong> by Jeffery and Katauskas C<strong>on</strong>sulting Engineers and the pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>al<br />

geotechnical input over the course <str<strong>on</strong>g>of</str<strong>on</strong>g> the works, must <str<strong>on</strong>g>be</str<strong>on</strong>g> compiled in report format and<br />

submitted <str<strong>on</strong>g>to</str<strong>on</strong>g> the Principal Certifying Authority for approval.<br />

132. Prior <str<strong>on</strong>g>to</str<strong>on</strong>g> occupati<strong>on</strong>, issue <str<strong>on</strong>g>of</str<strong>on</strong>g> an Occupati<strong>on</strong> Certificate or issue <str<strong>on</strong>g>of</str<strong>on</strong>g> the Final Compliance<br />

Certificate, an easement for waste collecti<strong>on</strong> must <str<strong>on</strong>g>be</str<strong>on</strong>g> provided. This is <str<strong>on</strong>g>to</str<strong>on</strong>g> permit legal access<br />

for Council, and Council’s c<strong>on</strong>trac<str<strong>on</strong>g>to</str<strong>on</strong>g>rs, and their vehicles over the subject property for the<br />

purpose <str<strong>on</strong>g>of</str<strong>on</strong>g> collecting waste from the property. The terms <str<strong>on</strong>g>of</str<strong>on</strong>g> the easement are <str<strong>on</strong>g>to</str<strong>on</strong>g> indemnify<br />

Council and Council’s c<strong>on</strong>trac<str<strong>on</strong>g>to</str<strong>on</strong>g>rs against damages <str<strong>on</strong>g>to</str<strong>on</strong>g> private land or property whilst in the<br />

course <str<strong>on</strong>g>of</str<strong>on</strong>g> carrying out waste collecti<strong>on</strong> services. The terms <str<strong>on</strong>g>of</str<strong>on</strong>g> the easement are <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g> generally<br />

in accordance with Council’s draft terms for an easement for waste collecti<strong>on</strong>.<br />

133. Prior <str<strong>on</strong>g>to</str<strong>on</strong>g> occupati<strong>on</strong>, issue <str<strong>on</strong>g>of</str<strong>on</strong>g> an Occupati<strong>on</strong> Certificate or issue <str<strong>on</strong>g>of</str<strong>on</strong>g> the Final Compliance<br />

Certificate (and at the completi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> works), a closed circuit televisi<strong>on</strong> (CCTV) inspecti<strong>on</strong> and<br />

report <strong>on</strong> the Council drainage pipeline traversing the subject property is <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g> undertaken by<br />

appropriate c<strong>on</strong>trac<str<strong>on</strong>g>to</str<strong>on</strong>g>rs and provided <str<strong>on</strong>g>to</str<strong>on</strong>g> Council, attenti<strong>on</strong> Development Engineer. The report<br />

is <str<strong>on</strong>g>to</str<strong>on</strong>g> include a copy <str<strong>on</strong>g>of</str<strong>on</strong>g> the footage <str<strong>on</strong>g>of</str<strong>on</strong>g> the inside <str<strong>on</strong>g>of</str<strong>on</strong>g> the pipeline. Any damage that has occurred<br />

<str<strong>on</strong>g>to</str<strong>on</strong>g> the secti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the pipeline since the commencement <str<strong>on</strong>g>of</str<strong>on</strong>g> c<strong>on</strong>structi<strong>on</strong> <strong>on</strong> the site must <str<strong>on</strong>g>be</str<strong>on</strong>g><br />

repaired in full <str<strong>on</strong>g>to</str<strong>on</strong>g> the satisfacti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> Council’s Development Engineer at no cost <str<strong>on</strong>g>to</str<strong>on</strong>g> Council.<br />
