I move:<br />

"1. That Council use the c<strong>on</strong>stituti<strong>on</strong>al referendum process as outlined in Part 3 <str<strong>on</strong>g>of</str<strong>on</strong>g> the<br />

Local Government Act 1993 (Secti<strong>on</strong>s 15 – 20), and Secti<strong>on</strong>s 224 and 228.<br />

2. That Council c<strong>on</strong>duct the c<strong>on</strong>stituti<strong>on</strong>al referendum at the earliest time practicable.<br />

3. That a further report <str<strong>on</strong>g>be</str<strong>on</strong>g> brought <str<strong>on</strong>g>to</str<strong>on</strong>g> Council with recommendati<strong>on</strong>s for appropriate<br />

wording <str<strong>on</strong>g>of</str<strong>on</strong>g> referendum questi<strong>on</strong>s and opti<strong>on</strong>s for Ward changes.<br />

4. That for this purpose, extra funds <str<strong>on</strong>g>of</str<strong>on</strong>g> $20,000 per year, <str<strong>on</strong>g>be</str<strong>on</strong>g> programmed in<str<strong>on</strong>g>to</str<strong>on</strong>g> Council’s<br />

L<strong>on</strong>g Term Financial Model for the financial years 2007–08 <strong>on</strong>wards."<br />

Notice <str<strong>on</strong>g>of</str<strong>on</strong>g> Moti<strong>on</strong> from Councillor M Shelley & Cr Lane dated 7 July <strong>2006</strong>.<br />

The Principal <str<strong>on</strong>g>of</str<strong>on</strong>g> the Lindfield Public School and the Parents and Citizens Associati<strong>on</strong> have<br />

expressed c<strong>on</strong>cern for the safety <str<strong>on</strong>g>of</str<strong>on</strong>g> school children crossing the Pacific Highway at<br />

Lindfield adjacent <str<strong>on</strong>g>to</str<strong>on</strong>g> Grosvenor Road Lindfield. The school has requested Council’s<br />

assistance with the provisi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> a pedestrian bridge over the Highway at this locati<strong>on</strong>.<br />

As the site is c<strong>on</strong>sidered <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g> out <str<strong>on</strong>g>of</str<strong>on</strong>g> the proposed <str<strong>on</strong>g>to</str<strong>on</strong>g>wn centre area, it would <str<strong>on</strong>g>be</str<strong>on</strong>g> difficult for<br />

this Council <str<strong>on</strong>g>to</str<strong>on</strong>g> fund such a project using Secti<strong>on</strong> 94 funds. C<strong>on</strong>sequently, funding for this<br />

project would need <str<strong>on</strong>g>to</str<strong>on</strong>g> come from other sources within Council unless the project could <str<strong>on</strong>g>be</str<strong>on</strong>g><br />

funded through the Roads and Traffic Authority (RTA) programs.<br />

The RTA have advised that Council would need <str<strong>on</strong>g>to</str<strong>on</strong>g> provide supporting informati<strong>on</strong> <strong>on</strong> the<br />

pedestrian demands and accident data with their submissi<strong>on</strong> for c<strong>on</strong>siderati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> a pedestrian<br />

bridge at this locati<strong>on</strong>. However, the RTA indicated that there would <str<strong>on</strong>g>be</str<strong>on</strong>g> support for such a<br />
