access in accordance with the abovementi<strong>on</strong>ed objectives.<br />

The proposed signage does not fall under the ‘prohibited’ signage criteria within the DCP and<br />

is acceptable. The signs are at awning level and <str<strong>on</strong>g>be</str<strong>on</strong>g>low in accordance with the DCP and are<br />

not illuminated. The signage complies with Schedule 1 <str<strong>on</strong>g>of</str<strong>on</strong>g> the DCP in relati<strong>on</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g> technical<br />

design requirements and is acceptable for approval.<br />

Development C<strong>on</strong>trol Plan 31 – Access<br />

The existing building provides at grade access from the footpath in<str<strong>on</strong>g>to</str<strong>on</strong>g> the premises and a<br />

c<strong>on</strong>tinuous path <str<strong>on</strong>g>of</str<strong>on</strong>g> travel for access. A c<strong>on</strong>diti<strong>on</strong> is recommended in relati<strong>on</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g> access. Refer<br />

<str<strong>on</strong>g>to</str<strong>on</strong>g> C<strong>on</strong>diti<strong>on</strong> No. 24.<br />

The DCP requires that, for existing buildings which are the subject <str<strong>on</strong>g>of</str<strong>on</strong>g> a change <str<strong>on</strong>g>of</str<strong>on</strong>g> use,<br />

development should provide access in accordance with the Building Code <str<strong>on</strong>g>of</str<strong>on</strong>g> Australia. Refer<br />

<str<strong>on</strong>g>to</str<strong>on</strong>g> recommended C<strong>on</strong>diti<strong>on</strong> No. 25 in this regard.<br />

One disabled/accessible car space is provided directly <str<strong>on</strong>g>to</str<strong>on</strong>g> the rear <str<strong>on</strong>g>of</str<strong>on</strong>g> the premises which meets<br />

the requirement <str<strong>on</strong>g>of</str<strong>on</strong>g> Clause 12 <str<strong>on</strong>g>of</str<strong>on</strong>g> DCP 31.<br />

1. LIKELY IMPACTS<br />

The proposal is unlikely <str<strong>on</strong>g>to</str<strong>on</strong>g> have any significant impact <strong>on</strong> the envir<strong>on</strong>ment, landscape or<br />

scenic quality <str<strong>on</strong>g>of</str<strong>on</strong>g> the locality, threatened species, populati<strong>on</strong>s or ecological communities or<br />

their habitats or any other protected fauna or protected native plants.<br />

The site is not within a wilderness area nor an area <str<strong>on</strong>g>of</str<strong>on</strong>g> critical habit.<br />

2. SUITABILITY OF THE SITE<br />

The site is commercially z<strong>on</strong>ed and has <str<strong>on</strong>g>be</str<strong>on</strong>g>en used his<str<strong>on</strong>g>to</str<strong>on</strong>g>rically for business, retail purposes.<br />

The site is suitable for the development proposed.<br />

3. ANY SUBMISSIONS<br />

The submissi<strong>on</strong>s raised have <str<strong>on</strong>g>be</str<strong>on</strong>g>en c<strong>on</strong>sidered.<br />

4. PUBLIC INTEREST<br />

Subject <str<strong>on</strong>g>to</str<strong>on</strong>g> c<strong>on</strong>diti<strong>on</strong>s, the proposal is c<strong>on</strong>sidered <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g> in the public interest.<br />

CONCLUSION<br />

The proposed development complies with the provisi<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> the KPSO and relevant DCP guidelines<br />

and c<strong>on</strong>trols. Subject <str<strong>on</strong>g>to</str<strong>on</strong>g> c<strong>on</strong>diti<strong>on</strong>s, the proposal will not result in any unreas<strong>on</strong>able adverse impacts<br />
