setback <str<strong>on</strong>g>of</str<strong>on</strong>g> 15m. The setback for the 5th floor is 15.5 metres and exceeds Council’s<br />

guidelines.<br />

The southern elevati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> Block B, which faces the heritage item, mainly c<strong>on</strong>tains <str<strong>on</strong>g>be</str<strong>on</strong>g>drooms,<br />

however the middle secti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the building c<strong>on</strong>tains living areas which are setback an<br />

additi<strong>on</strong>al 5.5 metres from the facade and provide a <str<strong>on</strong>g>to</str<strong>on</strong>g>tal setback <str<strong>on</strong>g>of</str<strong>on</strong>g> 19 metres from the<br />

heritage building this exceeds the guidelines in DCP 55. The southern facade, directly<br />

adjoining the heritage item is relatively flat with the central part set back. The applicant’s<br />

heritage report c<strong>on</strong>cludes that:<br />

“The proposal is c<strong>on</strong>sistent with the desired future character <str<strong>on</strong>g>of</str<strong>on</strong>g> the area and dem<strong>on</strong>strates<br />

compliance with the existing c<strong>on</strong>trols regarding heritage c<strong>on</strong>servati<strong>on</strong>.”<br />

The applicant was advised that there is some n<strong>on</strong>-compliance in the setbacks adjacent <str<strong>on</strong>g>to</str<strong>on</strong>g> the<br />

heritage item. There was also some c<strong>on</strong>cerns with landscape and urban design issues. Those<br />

issues have largely <str<strong>on</strong>g>be</str<strong>on</strong>g>en resolved, with later amendments and c<strong>on</strong>diti<strong>on</strong>s. However, the<br />

applicant did not amend the minor n<strong>on</strong>-compliance with the side setback <strong>on</strong> the third and<br />

fourth floor levels.<br />

The amount <str<strong>on</strong>g>of</str<strong>on</strong>g> n<strong>on</strong>-compliance in setback from the neighboring heritage item is relatively<br />

small, comprising about a third <str<strong>on</strong>g>of</str<strong>on</strong>g> the southern elevati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> proposed “Block B” (plan<br />

measurement) and <strong>on</strong>ly relates <str<strong>on</strong>g>to</str<strong>on</strong>g> two floors within the building. Given that the two lower<br />

floors and the <str<strong>on</strong>g>to</str<strong>on</strong>g>p floor all exceed the required setbacks and that amendments <str<strong>on</strong>g>to</str<strong>on</strong>g> the design<br />

and landscaping <str<strong>on</strong>g>of</str<strong>on</strong>g> the scheme has resulted in a satisfac<str<strong>on</strong>g>to</str<strong>on</strong>g>ry outcome, it is my opini<strong>on</strong> that<br />

given the heritage objectives and guidelines in DCP 55 the overall applicati<strong>on</strong> and its impacts<br />

<strong>on</strong> the heritage item at 2 Nulla Nulla Street is acceptable.<br />

C<strong>on</strong>clusi<strong>on</strong>s<br />

Demoliti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the existing houses <strong>on</strong> the site is acceptable, provided archival recording <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

each building is undertaken <str<strong>on</strong>g>be</str<strong>on</strong>g>fore works commence <strong>on</strong> the site.<br />

On balance, the amendments <str<strong>on</strong>g>to</str<strong>on</strong>g> the applicati<strong>on</strong> have assisted in providing a more acceptable<br />

outcome in terms <str<strong>on</strong>g>of</str<strong>on</strong>g> fit within the exiting streetscape and with the nearby heritage item.<br />

In relati<strong>on</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g> the heritage setback requirements in DCP 55, ‘Block B’ does not fully comply<br />

with the required setback for about a third <str<strong>on</strong>g>of</str<strong>on</strong>g> the southern elevati<strong>on</strong> <strong>on</strong> levels three and four.<br />

Given that the two lower floors and the <str<strong>on</strong>g>to</str<strong>on</strong>g>p floor all exceed the required setbacks and that<br />

amendments <str<strong>on</strong>g>to</str<strong>on</strong>g> the design and landscaping <str<strong>on</strong>g>of</str<strong>on</strong>g> the scheme has resulted in a satisfac<str<strong>on</strong>g>to</str<strong>on</strong>g>ry<br />

outcome, it is my opini<strong>on</strong> that the overall heritage objectives and guidelines in DCP 55 have<br />

<str<strong>on</strong>g>be</str<strong>on</strong>g>en met and the minor n<strong>on</strong>-compliance in setback is acceptable. The overall impact <strong>on</strong> the<br />

heritage item at 2 Nulla Nulla Street is c<strong>on</strong>sidered satisfac<str<strong>on</strong>g>to</str<strong>on</strong>g>ry.”<br />

Landscaping<br />

Council’s Landscape Assessment Officer, Mr Ge<str<strong>on</strong>g>of</str<strong>on</strong>g>f Bird, made the following comments:<br />
