All works carried out for the site must <strong>be</strong> conducted according <strong>to</strong> relevant legislation and workcover
requirements, including the safe removal <strong>of</strong> as<strong>be</strong>s<strong>to</strong>s. Safety during construction in terms <strong>of</strong>
vehicles will <strong>be</strong> address via the Construction Traffic Management Plan.
Consideration has <strong>be</strong>en given <strong>to</strong> the security <strong>of</strong> the adjoining development in terms <strong>of</strong> Crime
Prevention Through Environmental Design Principles (CPTED). The proposal is reasonable in this
regard and will <strong>of</strong>fer a degree <strong>of</strong> passive surveillance which discourages criminal <strong>be</strong>haviour.
Council is not in a position <strong>to</strong> require the applicant <strong>to</strong> replace the existing a side boundary fence at
their expense. This is an issue for the private property owners.
Damage/ impacts during construction
Conditions <strong>of</strong> consent are recommended <strong>to</strong> minimise impacts <strong>of</strong> the development during the
construction process (Conditions Nos 23,76). Typical conditions will include compliance with
noise regulations, suppression <strong>of</strong> dust during construction and dilapidation reports for the adjoining
development. This is also supported by conditions restricting the hours <strong>of</strong> work and appropriate
traffic management. It is also not reasonable under the EPA Act, 1979 <strong>to</strong> require that ‘on
completion, the washing and re-painting <strong>of</strong> houses within a 70 metres radius <strong>of</strong> the site’. A
condition is recommended in this regard (Condition No. 23) <strong>to</strong> minimise dust impact <strong>to</strong> the
surrounding properties during construction.
Landscaping
Landscaping <strong>of</strong> the site will ensure adequate amenity <strong>to</strong> the surrounding properties as well as
ensuring that the development integrates in<strong>to</strong> the streetscape.
Impacts on heritage item
The impacts <strong>to</strong> the heritage item are acceptable for the reasons given within this report. Residents
stated that there were a num<strong>be</strong>r <strong>of</strong> inconsistencies <strong>be</strong>tween Council’s heritage planning controls and
that <strong>of</strong> the applicant’s submission. These points have <strong>be</strong>en noted and considered under the
assessment <strong>of</strong> the application. The proposal does not adversely impact upon the adjoining heritage
item.
Detriment <strong>to</strong> property values
This is not relevant consideration under the EPA Act 1979.
Variations <strong>to</strong> planning controls
The impact(s) <strong>of</strong> the non-compliances have <strong>be</strong>en assessed under the body <strong>of</strong> this report. Those
variations are reasonable in this instance.
Council must <strong>be</strong> the principal certifying authority
The EP & A Act allows the applicant <strong>to</strong> choose either a private PCA or Ku-ring-gai Council.
