All works carried out for the site must <str<strong>on</strong>g>be</str<strong>on</strong>g> c<strong>on</strong>ducted according <str<strong>on</strong>g>to</str<strong>on</strong>g> relevant legislati<strong>on</strong> and workcover<br />

requirements, including the safe removal <str<strong>on</strong>g>of</str<strong>on</strong>g> as<str<strong>on</strong>g>be</str<strong>on</strong>g>s<str<strong>on</strong>g>to</str<strong>on</strong>g>s. Safety during c<strong>on</strong>structi<strong>on</strong> in terms <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

vehicles will <str<strong>on</strong>g>be</str<strong>on</strong>g> address via the C<strong>on</strong>structi<strong>on</strong> Traffic Management Plan.<br />

C<strong>on</strong>siderati<strong>on</strong> has <str<strong>on</strong>g>be</str<strong>on</strong>g>en given <str<strong>on</strong>g>to</str<strong>on</strong>g> the security <str<strong>on</strong>g>of</str<strong>on</strong>g> the adjoining development in terms <str<strong>on</strong>g>of</str<strong>on</strong>g> Crime<br />

Preventi<strong>on</strong> Through Envir<strong>on</strong>mental Design Principles (CPTED). The proposal is reas<strong>on</strong>able in this<br />

regard and will <str<strong>on</strong>g>of</str<strong>on</strong>g>fer a degree <str<strong>on</strong>g>of</str<strong>on</strong>g> passive surveillance which discourages criminal <str<strong>on</strong>g>be</str<strong>on</strong>g>haviour.<br />

Council is not in a positi<strong>on</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g> require the applicant <str<strong>on</strong>g>to</str<strong>on</strong>g> replace the existing a side boundary fence at<br />

their expense. This is an issue for the private property owners.<br />

Damage/ impacts during c<strong>on</strong>structi<strong>on</strong><br />

C<strong>on</strong>diti<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> c<strong>on</strong>sent are recommended <str<strong>on</strong>g>to</str<strong>on</strong>g> minimise impacts <str<strong>on</strong>g>of</str<strong>on</strong>g> the development during the<br />

c<strong>on</strong>structi<strong>on</strong> process (C<strong>on</strong>diti<strong>on</strong>s Nos 23,76). Typical c<strong>on</strong>diti<strong>on</strong>s will include compliance with<br />

noise regulati<strong>on</strong>s, suppressi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> dust during c<strong>on</strong>structi<strong>on</strong> and dilapidati<strong>on</strong> reports for the adjoining<br />

development. This is also supported by c<strong>on</strong>diti<strong>on</strong>s restricting the hours <str<strong>on</strong>g>of</str<strong>on</strong>g> work and appropriate<br />

traffic management. It is also not reas<strong>on</strong>able under the EPA Act, 1979 <str<strong>on</strong>g>to</str<strong>on</strong>g> require that ‘<strong>on</strong><br />

completi<strong>on</strong>, the washing and re-painting <str<strong>on</strong>g>of</str<strong>on</strong>g> houses within a 70 metres radius <str<strong>on</strong>g>of</str<strong>on</strong>g> the site’. A<br />

c<strong>on</strong>diti<strong>on</strong> is recommended in this regard (C<strong>on</strong>diti<strong>on</strong> No. 23) <str<strong>on</strong>g>to</str<strong>on</strong>g> minimise dust impact <str<strong>on</strong>g>to</str<strong>on</strong>g> the<br />

surrounding properties during c<strong>on</strong>structi<strong>on</strong>.<br />

Landscaping<br />

Landscaping <str<strong>on</strong>g>of</str<strong>on</strong>g> the site will ensure adequate amenity <str<strong>on</strong>g>to</str<strong>on</strong>g> the surrounding properties as well as<br />

ensuring that the development integrates in<str<strong>on</strong>g>to</str<strong>on</strong>g> the streetscape.<br />

Impacts <strong>on</strong> heritage item<br />

The impacts <str<strong>on</strong>g>to</str<strong>on</strong>g> the heritage item are acceptable for the reas<strong>on</strong>s given within this report. Residents<br />

stated that there were a num<str<strong>on</strong>g>be</str<strong>on</strong>g>r <str<strong>on</strong>g>of</str<strong>on</strong>g> inc<strong>on</strong>sistencies <str<strong>on</strong>g>be</str<strong>on</strong>g>tween Council’s heritage planning c<strong>on</strong>trols and<br />

that <str<strong>on</strong>g>of</str<strong>on</strong>g> the applicant’s submissi<strong>on</strong>. These points have <str<strong>on</strong>g>be</str<strong>on</strong>g>en noted and c<strong>on</strong>sidered under the<br />

assessment <str<strong>on</strong>g>of</str<strong>on</strong>g> the applicati<strong>on</strong>. The proposal does not adversely impact up<strong>on</strong> the adjoining heritage<br />

item.<br />

Detriment <str<strong>on</strong>g>to</str<strong>on</strong>g> property values<br />

This is not relevant c<strong>on</strong>siderati<strong>on</strong> under the EPA Act 1979.<br />

Variati<strong>on</strong>s <str<strong>on</strong>g>to</str<strong>on</strong>g> planning c<strong>on</strong>trols<br />

The impact(s) <str<strong>on</strong>g>of</str<strong>on</strong>g> the n<strong>on</strong>-compliances have <str<strong>on</strong>g>be</str<strong>on</strong>g>en assessed under the body <str<strong>on</strong>g>of</str<strong>on</strong>g> this report. Those<br />

variati<strong>on</strong>s are reas<strong>on</strong>able in this instance.<br />

Council must <str<strong>on</strong>g>be</str<strong>on</strong>g> the principal certifying authority<br />

The EP & A Act allows the applicant <str<strong>on</strong>g>to</str<strong>on</strong>g> choose either a private PCA or Ku-ring-gai Council.<br />
