It may cause manypeople of color to plan their driv<strong>in</strong>g <strong>and</strong> travel routes <strong>in</strong> certa<strong>in</strong> ways, to take(or not take) particular jobs, even to wear cloth<strong>in</strong>g <strong>and</strong> behave <strong>in</strong> ways thatm<strong>in</strong>imize their potential to attract police attention. They may simply stayout of places <strong>and</strong> neighborhoods where they will "st<strong>and</strong> out"-where policemay feel they don't "belong" .... Some even feel compelled to change thedetails of their personal behavior or appearance. They wear their suits, ties,<strong>and</strong> clerical collars as a k<strong>in</strong>d of sartorial armor, or remove th<strong>in</strong>gs they wouldnormally wear.84Where the dem<strong>and</strong>s of the economy conflict with those of segregation, theenforcement of White supremacy may take a different, but familiar, form. In theIndianapolis suburb of Carmel, for example, a communications company relieslargely on Black workers from outside the immediate area. After an embarrass<strong>in</strong>glawsuit, the police department issued the workers special tags for theirvehicles. These would signal to the police that they should be allowed to travelthrough the area. Harris compares this with the pass system <strong>in</strong> apartheid-eraSouth Africa.H' But closer analogies are available: passes, as we've seen, were amajor feature of the slave system, were then applied to free Black people, <strong>and</strong>survived Emancipation as a means of limit<strong>in</strong>g the mobility of Black people.Race-based polic<strong>in</strong>g, <strong>and</strong> especially the fear of B1ack crim<strong>in</strong>ality, has amore subtle function as well-ma<strong>in</strong>ta<strong>in</strong><strong>in</strong>g the ideological basis of Whiteunity <strong>and</strong> <strong>in</strong>directly controll<strong>in</strong>g the political allegiances of White people.While people of color are the targets of racial profil<strong>in</strong>g, there are actuallytwo audiences for such pollce activity. Profil<strong>in</strong>g serves to humiliate <strong>and</strong>threaten those who are targeted; even when it does not lead to crim<strong>in</strong>alsanction<strong>in</strong>g, it serves as a not-very-subtle rem<strong>in</strong>der of their "place." And ithelps to align White people "vith thc power structure by conv<strong>in</strong>c<strong>in</strong>g themthat the state protects them from purportedly crim<strong>in</strong>al people of color.86I have argued that racial profil<strong>in</strong>g has more to do with ma<strong>in</strong>ta<strong>in</strong><strong>in</strong>g Whitesupremacy than with fight<strong>in</strong>g crime. On the one h<strong>and</strong>, profil<strong>in</strong>g is over<strong>in</strong>clusive;a great many <strong>in</strong>nocent people are treated with suspicion for noreason besides their race. On the other h<strong>and</strong>, White people are, somehow,exempt from the statistical reason<strong>in</strong>g used to justify profil<strong>in</strong>g. With this <strong>in</strong>m<strong>in</strong>d, it is worth consider<strong>in</strong>g the status of crimes associated with dom<strong>in</strong>antgroups. Rather than produc<strong>in</strong>g profiles <strong>and</strong> lead<strong>in</strong>g to concentrated enforcement,these crimes are downplayed, legitimized, treated leniently, or evendecrim<strong>in</strong>alized.s7 Thus, the possession of crack coca<strong>in</strong>e is punished muchmore harshly than that of powder coca<strong>in</strong>e.People convicted of possess<strong>in</strong>g five grams of crack get a m<strong>in</strong>imum prisonterm of five years. It takes 500 grams of powder to draw the same sentence.Those serv<strong>in</strong>g time for crack tend to be disproportionately black. ... Powderis more <strong>in</strong> use among whites. RR90
