Too many people have been spied upon by too many Government agencies<strong>and</strong> to [sic] much <strong>in</strong>formation has been collected. The Government hasoften undertaken the secret surveillance of citizens on the basis of theirpolitical beliefs, even when these beliefs posed no threat of violence orillegal acts on behalf of a hostile foreign power. The Government, operat<strong>in</strong>gprimarily through secret <strong>in</strong>formants, but also us<strong>in</strong>g other <strong>in</strong>trusivetechniques such as wiretaps, microphone "bugs", surreptitious mailopen<strong>in</strong>g, <strong>and</strong> break-<strong>in</strong>s, has swept <strong>in</strong> vast amounts of <strong>in</strong>formation aboutthe personal lives, views, <strong>and</strong> associations of <strong>America</strong>n citizens. Investigationsof groups deemed potentially dangerous-<strong>and</strong> even of groupssuspected of associat<strong>in</strong>g with potentially dangerous organizations-havecont<strong>in</strong>ued for decades, despite the fact that those groups did not engage<strong>in</strong> unlawful activity. Groups <strong>and</strong> <strong>in</strong>dividuals have been harassed <strong>and</strong> disruptedbecause of their political views <strong>and</strong> their lifestyles. Investigationshave been based upon vague st<strong>and</strong>ards whose breadth made excessivecollection <strong>in</strong>evitable. Unsavory <strong>and</strong> vicious tactics have been employed<strong>in</strong>clud<strong>in</strong>ganonymous attempts to break up marriages, disrupt meet<strong>in</strong>gs,ostracize persons from their professions, <strong>and</strong> provoke target groups <strong>in</strong>torivalries that might result <strong>in</strong> deaths. Intelligence agencies have servedthe political <strong>and</strong> personal objectives of presidents <strong>and</strong> other high officials.While the agencies often committed excesses <strong>in</strong> response to pressurefrom high officials <strong>in</strong> the Executive branch <strong>and</strong> Congress, they alsooccasionally <strong>in</strong>itiated improper activities <strong>and</strong> then concealed them fromofficials whom they had a duty to <strong>in</strong>form.!lWith this <strong>in</strong> view, the political operations touched on here, <strong>and</strong> the abusesthat accompanied them, cannot be dismissed as the excesses of <strong>in</strong>dividual, overzealousofficers, or even as the dysfunctions of particular departments. Instead,they should be understood as systematic <strong>in</strong> nature, <strong>in</strong>stitutional <strong>in</strong> scope,affect<strong>in</strong>g the entire country, <strong>and</strong> (despite their purported aims) underm<strong>in</strong><strong>in</strong>gdemocracy. 1bis is certa<strong>in</strong>ly true of the most flagrant abuses, but it may alsobe true of "legitimate" <strong>in</strong>telligence operations. However restra<strong>in</strong>ed, <strong>in</strong>telligenceactivities function to suppress dissent <strong>and</strong> undercut basic political liberties. YaleUniversity law professor Thomas Emerson expla<strong>in</strong>s:The very process of <strong>in</strong>vestigat<strong>in</strong>g political activities, <strong>in</strong>volv<strong>in</strong>g the question<strong>in</strong>gof friends, neighbors, employers <strong>and</strong> other government agents, is<strong>in</strong>timidat<strong>in</strong>g. The compil<strong>in</strong>g of dossiers, which may be the basis of <strong>in</strong>ternment<strong>in</strong> the event of emergency or of other reprisals, is threaten<strong>in</strong>g. Thevery existence of agents, <strong>in</strong>formers, <strong>and</strong> possible agents provocateurs ischill<strong>in</strong>g. Opportunities for partisan abuse of <strong>in</strong>telligence powers becomeavailable <strong>and</strong> tempt<strong>in</strong>g. Freedom of expression cannot exist under theseconditions.72Secret police are always the enemies of democracy.LOOKING AT THE LEFTAt every level of government, campaigns aga<strong>in</strong>st dissent have tended to focusdisproportionately on the activities of the left. In 1975 a former detective leakedto the press a list of organizations with files ma<strong>in</strong>ta<strong>in</strong>ed by the Baltimore <strong>Police</strong>161
