evealed an extensive pattern of political surveillance, much of it <strong>in</strong> violationof Oregon law. In particular, <strong>in</strong>formants had been used aga<strong>in</strong>st groups withno crim<strong>in</strong>al history, <strong>in</strong>clud<strong>in</strong>g those lobby<strong>in</strong>g for a civilian board to hear compla<strong>in</strong>tsaga<strong>in</strong>st the police. Squirrel was acquitted, <strong>and</strong> a subsequent lawsuitproduced a rul<strong>in</strong>g limit<strong>in</strong>g police surveillance activities to those attached toan ongo<strong>in</strong>g crim<strong>in</strong>al <strong>in</strong>vestigation. Despite the judge's rul<strong>in</strong>g, the surveillancecont<strong>in</strong>ued. After a 1998 protest aga<strong>in</strong>st the bomb<strong>in</strong>g of Iraq, another activist,Dan H<strong>and</strong>elman, was surprised to see his name <strong>in</strong> a police report, with a briefsynopsis of his political work:The Peace <strong>and</strong> Justice Works Iraq Aff<strong>in</strong>ity Group has held numerous protests<strong>in</strong> the Portl<strong>and</strong> area concern<strong>in</strong>g U.S. <strong>in</strong>volvement with Iraq. This groupis headed by a subject named Dan R<strong>and</strong>leman [sic] who has been very active<strong>in</strong> call<strong>in</strong>g for, arrang<strong>in</strong>g, <strong>and</strong> sponsor<strong>in</strong>g these demonstrations. 12 3H<strong>and</strong>ehnan was not arrested at the event, <strong>and</strong> this political <strong>in</strong>formation-likelydrawn from other files--had no bear<strong>in</strong>g on any crim<strong>in</strong>al case.Together these examples show that the police are loath to respect any restrictionsplaced on their operations (whether by the legislature or by the courts) ,<strong>and</strong> that the agitator-subversion thesis rema<strong>in</strong>s alive <strong>and</strong> well. In fact, thoughnot yet apparent on the larger scale, there are <strong>in</strong>dications of COINTELPRO-styleabuses <strong>and</strong> even outright atrocities dur<strong>in</strong>g the Reagan-Bush-Cl<strong>in</strong>ton years.Consider, for <strong>in</strong>stance, the case ofJudi Bari-bombed by persons unknown,then unsuccessfully framed by the Oakl<strong>and</strong> police <strong>and</strong> the FBI. Bari was seriously<strong>in</strong>jured on March 24, 1990, when a pipe bomb exploded under the seat ofher car; Darryl Cherney was also <strong>in</strong> the vehicle, <strong>and</strong> was also <strong>in</strong>jured, thoughnot as badly. The two were members of the radical environmental groupEarth First! <strong>and</strong> were <strong>in</strong> the midst of organiz<strong>in</strong>g a civil disobedience campaignaga<strong>in</strong>st logg<strong>in</strong>g <strong>in</strong> Northern California. In the weeks before the attack, theyhad received numerous death threats, which the police decl<strong>in</strong>ed to <strong>in</strong>vestigate.When the bomb exploded, the cops--under the always helpful guidance ofthe FBI-were quick to blame the victims: Barl <strong>and</strong> Cherney were arrestedfor transport<strong>in</strong>g explosives <strong>and</strong> br<strong>and</strong>ed <strong>in</strong> the media as terrorists. But thephysical evidence did not match the official theory that Bari <strong>and</strong> Cherney wereknow<strong>in</strong>gly transport<strong>in</strong>g explosives. The damage to the car, <strong>and</strong> to Bari herself,<strong>in</strong>dicated that the bomb was under the driver's seat, not <strong>in</strong> the back seat wherethe police said it had been. The DA decl<strong>in</strong>ed to prosecute, the police refused tolook for other suspects, <strong>and</strong> Bari <strong>and</strong> Cherney sued.124The lawsuit brought forth evidence suggestive of possibilities far mores<strong>in</strong>ister than simple <strong>in</strong>competence-<strong>in</strong>clud<strong>in</strong>g details of an FBI-run bombschool held on lumber company property weeks before the explosion. In thecourse of the tra<strong>in</strong><strong>in</strong>g, Special Agent Frank Doyle simulated a bomb<strong>in</strong>g identicalto that which <strong>in</strong>jured Barl <strong>and</strong> Cherney a month later. l lj The jury becameconv<strong>in</strong>ced that Bari <strong>and</strong> Cherney'S civil rights had been violated, <strong>and</strong> <strong>in</strong> June2002, awarded them $4.4 million. 1be jury explicitly recognized the politicalmotivations beh<strong>in</strong>d the police misconduct: violations of the pla<strong>in</strong>tiffs' FirstAmendment rights represented 80 percent of the damages.126 One unnamedjuror told the Press Democrat, 'There were too many lies <strong>and</strong> manipulation ofthe evidence.
