day shifts were worked) to night duty shall be free from duty during the twentyhours immediately preceding the commencement of the changed duty.8.8.5 Paragraph 8.8.4 shall not apply if the employee is required to perform duty toenable the services of the organisation to be carried on in an emergency.8.9 Programmed days off8.9.1 Eight hour shift employees8.9.1(a)8.9.1(b)A full-time employee who is engaged to work shifts of not longer than eightordinary hours shall be entitled to one programmed day off in each fourweek period which shall be nominated by the employer in accordance withthe rostering provisions of subclause 8.7.Notwithstanding anything contained in paragraph 8.9.1 or any otherprovision of this agreement, by mutual agreement between the employer andthe employee, a full-time employee may work an average of 38 ordinaryhours per week in a manner other than with a programmed day off, byeither:8.9.1(b)(i)8.9.1(b)(ii)Having one shift in each week of less than eight ordinary hours;orHaving one shift in each two week period of less than eighthours' duration.8.9.1(c)8.9.1(d)8.9.1(e)8.9.1(f)8.9.1(g)The day or days on which the shorter shifts shall be worked shall be asmutually agreed between the employer and the employee.Where either the employee or employer believes that the methods ofworking a 38 hour week contained in paragraph 8.9.1(b) are of benefit but isunable to reach agreement with the other party, the matter shall be dealtwith according to the dispute resolution procedures in clause 34.Notwithstanding anything else in this agreement, a full-time employee mayseek to defer or be requested to defer any programmed day off whichbecomes due for a period of up to three months, provided that the defermentis by mutual agreement.No more than five programmed days off may be deferred at any given time.Deferred programmed days off may be taken as single days or as a block inany manner mutually agreed.8.9.2 Extended night shift employees8.9.2(a)A full-time employee who is engaged to work an extended night shift ofbetween eight and ten ordinary hours shall be entitled to at least fourprogrammed days off in each twenty week period.Community Sector Multiple Enterprise Agreement 2009
8.9.2(b)Programmed days off shall be nominated in accordance with the rosteringprovisions of subclause 8.7.8.9.3 Work on a programmed day offAn employee required to work on a day nominated as a programmed day off shallbe paid for work in accordance with the overtime provisions of this agreement andshall not be entitled to an alternate programmed day off.8.9.4 Twelve hour shiftsBy agreement between the employer and the majority of employees at theworkplace, ordinary hours not exceeding twelve on any shift may be workedsubject to such an agreement being recorded in writing.
