23.2 Immediate family or household23.2.1 The entitlement to carer’s or bereavement leave is subject to <strong>the</strong> person in respectof whom <strong>the</strong> leave is taken being ei<strong>the</strong>r:23.2.1(a)23.2.1(b)a member of <strong>the</strong> employee’s immediate family; ora member of <strong>the</strong> employee’s household.23.2.2 The term immediate family includes:23.2.2(a)23.2.2(b)A spouse (including a former spouse, a de facto spouse and a former defacto spouse) of <strong>the</strong> employee. A de facto spouse, in relation to a person,means a person who lives with <strong>the</strong> first mentioned person as <strong>the</strong> partner ofthat person on a bona fide domestic basis although not legally married tothat person and includes same-sex partners; andchild or an adult child (including an adopted child, a step child or an exnuptialchild), parent, grandparent, grandchild or sibling of <strong>the</strong> employee orspouse of <strong>the</strong> employee.23.3 Sick leave23.3.1 An employee is entitled to use up to fifteen days of <strong>the</strong> current year’s personalleave entitlement as sick leave in <strong>the</strong> first year of service and fifteen days in <strong>the</strong>second and subsequent years of service.23.3.2 An employee is entitled to use accumulated personal leave for <strong>the</strong> purposes ofsick leave where <strong>the</strong> current year’s sick leave entitlement has been exhausted.23.3.3 Sick leave for more than three consecutive days requires <strong>the</strong> production of amedical certificate23.3.4 If <strong>the</strong> full period of sick leave as described above is not taken in any year, suchportion as is not taken shall be cumulative from year to year. There shall be nopayment of portions of leave not taken, on retirement or termination.23.3.5 Part day absencesFor <strong>the</strong> purpose of calculating deductions from sick leave accruals whereemployees taking such leave are absent for part of a day, <strong>the</strong> following procedureshall be used:23.3.5(a)23.3.5(b)Leave credits should be converted into hours on <strong>the</strong> basis of an eight hourday; andLeave taken to <strong>the</strong> nearest quarter of an hour, should <strong>the</strong>n be deducted fromthis total.23.3.6 Sickness on programmed day offWhere an employee is sick or injured on <strong>the</strong> weekday <strong>the</strong>y are to take off inaccordance with clause 7 or 8 he/she shall not be entitled to sick pay nor willCommunity Sector Multiple Enterprise Agreement 2009
