15.6 In <strong>the</strong> event that <strong>the</strong> employee receives a lump sum in redemption of weekly paymentsunder <strong>the</strong> appropriate Act or Ordinance, <strong>the</strong> liability of <strong>the</strong> employer to pay accidentmake-up payment as provided shall cease from <strong>the</strong> date of such redemption.16 SUPERANNUATION16.1 For <strong>the</strong> purposes of this clause all references to "<strong>the</strong> Approved fund" means ei<strong>the</strong>r <strong>the</strong>Health Employees Superannuation Trust Australia (HESTA); Australian SuperannuationSavings Employment Trust; Australian Super, or such o<strong>the</strong>r fund that complies with <strong>the</strong>Act and Regulations.16.2 "Earnings" means all amounts paid to an employee except payment(s) for overtime.16.3 "Eligible employee" - means any employee aged between 18 and 70, who is paid $450(before tax) or more in a calendar month, whe<strong>the</strong>r <strong>the</strong>y work full-time, part-time or on acasual basis. (in accordance with <strong>the</strong> Superannuation Guarantee (Administration) Act1992 as amended from time-to-time)16.4 The employer shall, in respect of each eligible employee, pay an amount equivalent to9% of <strong>the</strong> employee's earnings monthly into <strong>the</strong> approved fund.(in accordance with <strong>the</strong>Superannuation Guarantee (Administration) Act 1992 as amended from time-to-time)16.5 "The Employer" will provide all eligible employees who are not already members of <strong>the</strong>Approved Fund with a membership application form and will take such action as toensure that each eligible employee's completed application form is registered with <strong>the</strong>Fund.16.6 Where an eligible employee has failed to become a member of any of <strong>the</strong> ApprovedFunds, <strong>the</strong> employer will remit monthly contributions in accordance with subclause16.3 to HESTA providing, as a minimum, <strong>the</strong> employee's name, address and dateof birth.16.7 Paid leaveSubject to <strong>the</strong> trust deed of <strong>the</strong> fund of which <strong>the</strong> employee is a member, contributionsshall continue whilst a member of a fund is absent on paid leave such as annual leave,long service leave, public holidays, jury service, sick leave and bereavement leave.16.8 Unpaid leaveContributions shall not be required to be made in respect of any absence from workwithout pay.16.9 Work related injury and sickness16.9.1 In <strong>the</strong> event of an eligible employee's absence from work due to work related injury orsickness, contributions shall continue for <strong>the</strong> period of <strong>the</strong> absence (subject to amaximum of 52 weeks' total absence for each injury or sickness) provided that <strong>the</strong>Community Sector Multiple Enterprise Agreement 2009
