D1 Anglicare Canberra GoulburnThe following additional terms are only binding on Anglicare Canberra Goulburn and <strong>the</strong>employees of Anglicare Canberra Goulburn.1. This collective agreement applies to all employees of Anglicare Canberra & Goulburnexcept those engaged to work primarily in:a. nursing homesb. hostelsc. childcare in <strong>the</strong> ACT2. The following conditions of employment will continue to be determined under <strong>the</strong>relevant award of <strong>the</strong> Industrial Relations Commission of <strong>NSW</strong>:a. Classifications, base salaries*, shift penalties, on-call, sleep-over, publicholidays, first aid and shift length for employees engaged in social andcommunity services in <strong>NSW</strong>b. Classifications, base salaries*, shift penalties, public holidays, first aid andtravel time for employees engaged in community aged care in <strong>NSW</strong>c. Classifications, base salaries*, shift penalties, public holidays and first aid foremployees engaged in retail in <strong>NSW</strong>d. Classifications, base salaries*, shift penalties, public holidays, first aid andadditional annual leave for employees engaged in kindergartens in <strong>NSW</strong>e. Classifications, base salaries*, shift penalties, public holidays and first aid foremployees engaged in childcare and clerical/administration in <strong>NSW</strong>*s.206 of <strong>the</strong> Fair Work Act 2009 also requires base salaries to be at least <strong>the</strong> rate provided under any relevant modern award3. The following conditions of employment will continue to be determined under <strong>the</strong>relevant award of Fair Work Australia:a. Classifications, base salaries, shift penalties, public holidays and first aid foremployees engaged in clerical/administrationb. Classifications, base salaries, shift penalties, public holidays, first aid andtravel time for employees engaged in community aged care in <strong>the</strong> ACTc. Classifications, base salaries, public holidays and first aid for employeesengaged in family day care in <strong>the</strong> ACT and <strong>NSW</strong>4. Award free employees (within <strong>the</strong> meaning of <strong>the</strong> Fair Work Act 2009):a. Shall be allocated to a classification appropriate for <strong>the</strong>ir job within ScheduleC (see expanded definition of Community Services Worker Level 8 below)b. Are not entitled to overtime, allowances, shift penalties or holiday rates inaccordance with this collective agreementc. May enter into common law contracts that are inconsistent with <strong>the</strong> followingterms of this collective agreement:i. Clauses 6, 7, 8, 9, 10 and 11ii. Clauses 23, 24, 25 and 26iii. 5. A shift length of up to twelve ordinary hours may be worked by agreement with anindividual employee or established for a work area with <strong>the</strong> agreement of a majority of<strong>the</strong> employees in that work area.6. The sleep-over provisions of <strong>the</strong> Anglicare Canberra & Goulburn – AustralianServices Union – ACT Youth and Family Services Agreement 2008 shall continue toapply to employment in ACT youth refuges. The maximum shift including sleep-overhours is 18.5 hours.7. Clause 35 does not apply where serious allegations of misconduct/underperformancein relation to elder abuse, child protection, criminal acts or contractual compliance areprogressed in accordance with <strong>the</strong> principles of natural justice and Anglicare’sinvestigations policy, except that:a. Fair Work Australia may review a warning in accordance with clause 35.14b. An employee may be suspended in accordance with clause 35.16.28. Annual leave, personal leave and long service leave are to accrue fortnightly.9. Paid maternity, paternity and adoption leave is available under Anglicare’s parentalleave policy.10. Annual leave may be taken or cashed out in accordance with s.94 of <strong>the</strong> Fair Work Act2009. Anglicare does not encourage employees to cash out annual leave.11. Long service leave may be cashed out by agreement in writing between Anglicare andan employee. Anglicare does not encourage employees to cash out long service leave.12. The definition of Community Services Worker Level 8 includes all employeesengaged on a salary above <strong>the</strong> minimum salary in Clause 9 for a Community ServicesWorker Level 8.13. Motor vehicle allowance is paid at <strong>the</strong> rates determined by <strong>the</strong> Australian TaxationOffice or at <strong>the</strong> standard rate of $0.65 per kilometre for community aged care.Community Sector Multiple Business Agreements 2006
