f) The part-time equivalent of the full-time leave entitlement may be taken.However, the manner in which the leave is taken must be approved by theManagement Committee prior to the commencement of the leave. After theleave has commenced, alteration to the manner in which the leave is taken mayonly occur in exceptional circumstances and upon negotiation and agreement ata Management Committee meeting.g) For the purposes of the clause periods of leave without pay do not break but arenot counted towards continuous service.h) In considering an application for paid parental leave the ManagementCommittee shall have regard to the funds available for a replacement workerduring the term of the leave, and the necessity of employing a replacement forthat period.4. STUDY LEAVEa) At the discretion of the Management Committee, an employee may take up to75 hours per Semester paid study leave for a course which is not availableoutside office hours and which is of reasonable benefit to the work of theUnion. This leave entitlement is calculated on the basis of an employee takingup to 5 hours per week study leave over a 15 week Semester period. However,this leave can be taken as required, so long as the amount taken does notexceed the maximum of 75 hours per Semester.b) Study leave can only be taken for the purposes of attending lectures and examsor carrying out study in relation to the approved course.c) Study leave may also be granted for up to 5 hours per week for the weeksbetween Semesters if a need for this leave is demonstrated.d) At the discretion of the Management Committee, on the advice of staff, studyleave may be granted for short courses of up to 5 days duration.5. JURY SERVICEa) An employee shall be entitled to leave to attend jury service.b) During such leave of absence, an employee shall be paid the differencebetween the jury service fees received and the employee’s normal rate of pay,for a period of up to 10 days.6. LONG SERVICE LEAVEa) Employees are entitled to 13 weeks after 10 years service, and able to accesson a pro rata basis at 5 years. This accumulates at a rate of 1.3 weeks per year.An employee shall be entitled to pro rata long service leave after five yearsservice, such leave to be taken by mutual agreement between the employee andthe employer.Community Sector Multiple Business Agreements 2006
) Entitlements to long service leave are otherwise as determined by the LongService Leave Act 1976.c) On resignation after completing five years of service, an employee shall beentitled to a pro rata long service leave payment in lieu of any outstandingLong Service Leave. Any such payment shall be calculated on the basis of oneweek for each week of completed year of service less the amount of LongService Leave already taken, provided that, no employee will be required torefund to the employer any difference in entitlement between leave taken andpayment in lieu of leave.d) An application for Long Service Leave must be made to the ManagementCommittee Meeting and approved by the Management Committee. Threemonths notice must be given before leave is taken.The above clauses are from the TU conditions of employment.
