A joint consultative committee to monitor <strong>the</strong> implementation of this agreement shall beformed. It will comprise of equal numbers of employer and employee representatives.44. SAVINGS44.1 Nothing in this agreement shall be deemed or construed to reduce <strong>the</strong> entitlements of anemployee as <strong>the</strong>y existed at <strong>the</strong> time of operation of this agreement. Where superiorconditions to those in this agreement operate in any particular workplace, <strong>the</strong>n <strong>the</strong>employer will continue to offer such conditions to all current and all new employees for<strong>the</strong> life of <strong>the</strong> agreement.44.2 Nothing in this agreement shall be deemed or construed to reduce <strong>the</strong> entitlements anyemployee may have under any award, agreement or contract of employment.45. UNION DELEGATE’S LEAVE45.1 The employer will treat delegates fairly and to allow <strong>the</strong>m to perform <strong>the</strong>ir role as uniondelegate without any discrimination in <strong>the</strong>ir employment. The employer recognises andrespects that endorsed union delegates speak on behalf of union members in <strong>the</strong>workplace.45.2 The employer will grant delegates paid time off work to:• Prepare for and participate in collective bargaining on behalf of those <strong>the</strong>yrepresent;• Participate in consultation and access to reasonable information about <strong>the</strong>workplace and <strong>the</strong> business;• Reasonable paid time off work to represent <strong>the</strong> interests of members to <strong>the</strong>employer and industrial tribunals;• Reasonable paid time during normal working hours to consult with unionmembers;• Reasonable paid time off to participate in <strong>the</strong> operation of <strong>the</strong> union;• Reasonable paid time off to attend accredited union education;• Address new employees about <strong>the</strong> benefits of union membership at <strong>the</strong> time that<strong>the</strong>y enter employment;• Reasonable access to telephone, facsimile, photocopying, internet and e-mailfacilities for <strong>the</strong> purpose of carrying out work as a delegate and consulting withworkplace colleagues and <strong>the</strong> union;• Place union information on a notice board in a prominent location in <strong>the</strong>workplace.Community Sector Multiple Enterprise Agreement 2009
