15. Proxy. Personnel may nominate their spouse / civil partner or a Service proxy to<br />

view and select a property on their behalf. A proxy certificate is contained in the MOD<br />

contractor’s Accommodation User Guide. Decisions taken by the proxy are final and the<br />

applicant will have no subsequent redress. Accordingly, personnel should ensure that<br />

their proxy is reliable and fully understands their entitlement, and (if applicable) their<br />

personal preferences and resulting liability for personal contribution. Proxies should only<br />

be used as a last resort.<br />

16. Over entitlement properties. Personnel are not permitted to occupy overentitlement<br />

properties.<br />

17. Personal Interests in SSFA Property. SSFA claimants cannot accept or occupy an<br />

SSFA property which they own/part own 34 .<br />

18. Non selection <strong>of</strong> property. If an applicant (or their proxy) fails to accept one <strong>of</strong> the<br />

<strong>of</strong>fered properties, or delays making a decision at the time <strong>of</strong> the final viewing and<br />

consequently these properties are no longer available, they will be deemed to have put<br />

themselves outside the SSFA scheme, ie, they will be deemed to have waived their<br />

entitlement to publicly funded family accommodation and will be required to make private<br />

arrangements at their own expense (but see paragraph 38 regarding appeals).<br />

19. Notification <strong>of</strong> Address. Wherever possible, subject to the availability <strong>of</strong> suitable<br />

property, the contractor will provide the following notification <strong>of</strong> SSFA address:<br />

a. Moving within UK. Normally a minimum <strong>of</strong> 14 days prior to the required date<br />

as specified on the SSFA Application Form 1132A.<br />

b. Returning from overseas. Normally a minimum <strong>of</strong> 28 days prior to the<br />

required date as specified on the SSFA Application Form 1132A.<br />

SELF SOURCING OF SSFA<br />

20. Self-sourcing <strong>of</strong> SSFA is not permitted.<br />

ACCEPTANCE AND SSFA MOVE IN<br />

21. Property Acceptance Certificate. On selection <strong>of</strong> the preferred property personnel<br />

will be required to sign the Property Acceptance Certificate (PAC) which signifies their<br />

agreement to the property. Deficiencies, damages, lack <strong>of</strong> cleanliness and any agreement<br />

that remedial work (such as cleaning or redecoration) will be undertaken prior to<br />

occupation are to be recorded on the PAC and certified and dated by the MOD Contractor,<br />

DIO Ops Accommodation representative (if present) and the occupant. Failure to note<br />

discrepancies may negate later claims. The extent <strong>of</strong> any personal contribution<br />

(paragraph 13) is to be recorded on the PAC. A copy <strong>of</strong> the PAC will be kept by the MOD<br />

contractor.<br />

22. Licence to Occupy. Personnel will be required to sign a Property Acceptance<br />

Certificate which acknowledges their agreement to their Licence to Occupy the property<br />

which lays down the terms and conditions <strong>of</strong> occupancy (Annex B to Chapter 6 to TSARs<br />

34 Ownership <strong>of</strong> property includes both legal and beneficial ownership. Personnel will be considered to have beneficial (part)<br />

ownership <strong>of</strong> property if they have contributed to the purchase price by supplying capital (including a deposit payment) and/or by<br />

regularly paying/contributing to the mortgage payments.<br />
