0341 Families repatriated to UK from NI/overseas following estrangement. Families<br />

repatriated to UK following estrangement abroad have an entitlement to 93 days<br />

occupation <strong>of</strong> the nearest available SFA to their preferred area <strong>of</strong> choice in UK, or the<br />

balance <strong>of</strong> 93 days if the change <strong>of</strong> PStat Cat form had been previously signed prior to the<br />

families return to UK. At the point <strong>of</strong> occupancy the Housing Provider will also conduct a<br />

Proportionality Exercise to establish any continued occupancy beyond the expiry <strong>of</strong> the 93<br />

day notice to vacate, which should consider factors such as children’s schooling, relevant<br />

welfare and any medical considerations. The Service person’s former spouse/civil partner<br />

will pay SFA charges for the period <strong>of</strong> 93 days after the form is signed. The allocation <strong>of</strong><br />

SFA to an estranged spouse/civil partner after change in personal status category may be<br />

construed by Local Housing Authorities (LHA) as re-housing, and as such may prejudice<br />

LHA housing allocations. For this reason it is recommended that the change in personal<br />

category status is delayed until the spouse/civil partner returns to UK and is allocated SFA.<br />

Occupation <strong>of</strong> SSFA by estranged families is not permitted in view <strong>of</strong> the 6 month security<br />

<strong>of</strong> tenure provision in the tenancy agreement which exceeds the 93 day entitlement.<br />

0342 Estranged families in UK. Estranged families already in occupation <strong>of</strong> SFA in UK<br />

have an entitlement to remain in occupation <strong>of</strong> the SFA for a period <strong>of</strong> 93 days from the<br />

day that the HASC issue 93 days notice to vacate. As soon as the HASC is informed <strong>of</strong><br />

the change <strong>of</strong> PStat Cat <strong>of</strong> the Service Licensee they are to conduct the Proportionality<br />

Exercise to establish any continued occupancy beyond the expiry <strong>of</strong> the 93 day notice to<br />

vacate which should consider factors such as children’s schooling, relevant welfare and<br />

medical considerations. After completion <strong>of</strong> the Proportionality Exercise and consideration<br />

<strong>of</strong> educational needs, welfare and medical issues, the Housing Provider may issue a<br />

revised notice to vacate.<br />

SECTION VI<br />

UTILISATION OF SFA IN SUPPORT OF WELFARE<br />

0343 Management, financial arrangements and scaling. Where necessary, DIO Ops<br />

Accommodation will provide SFA from existing core stock for certain specified categories<br />

<strong>of</strong> welfare support. The admissible categories together with the management and financial<br />

arrangements are at Annex D. The scales for the provision <strong>of</strong> SFA for this purpose are at<br />

Annex E. Local Service Commanders intending to utilise SFA in support <strong>of</strong> welfare are to<br />

apply to the HASC.<br />
