5.2.1 Your personal status changes, resulting in loss <strong>of</strong> entitlement to Service Family<br />

Accommodation.<br />

5.2.2 You are discharged from the Services.<br />

5.2.3 You vacate the Property on matrimonial/civil partnership breakdown. What<br />

constitutes marital/civil partnership breakdown for the purposes <strong>of</strong> this Licence is set out in<br />

<strong>JSP</strong> <strong>464</strong>.<br />

5.2.4 Your spouse/civil partner vacates the Property on matrimonial/civil partnership<br />

breakdown and You are no longer entitled to occupation <strong>of</strong> Service Family<br />

Accommodation as set out in <strong>JSP</strong> <strong>464</strong>.<br />

5.2.5 You have been formally declared Absent Without Leave (AWOL) after 21 days.<br />

5.2.6 You are posted elsewhere.<br />

5.2.7 We require The Property for disposal or refurbishment.<br />

5.2.8 Any other case where the 28 day notice period in paragraph 5.3 does not apply<br />

5.3 We will give You 28 days’ notice <strong>of</strong> termination in the following cases:<br />

5.3.1 You breach the terms <strong>of</strong> this Licence.<br />

5.3.2 You are discharged from the Services on disciplinary grounds.<br />

5.3.3 You are only eligible (as opposed to entitled) to occupy Service Family<br />

Accommodation.<br />

5.4 If You remain in occupation <strong>of</strong> the Property after the period <strong>of</strong> notice <strong>of</strong><br />

termination expires You will be in unlawful occupation. In which case We may:<br />

5.4.1 Commence legal proceedings for the recovery <strong>of</strong> the Property from You.<br />

5.4.2 Seek damages from You, within these proceedings, in respect <strong>of</strong> Your unlawful<br />

occupation <strong>of</strong> the Property.<br />

5.4.3 Seek an order for Our costs from You at the conclusion <strong>of</strong> those proceedings.<br />

5.4.4 Such sums could be substantial.<br />

5.5 Subject to the provisions <strong>of</strong> this paragraph, in the event that You die in service,<br />

Your bereaved spouse/civil partner and any dependent children will be entitled to remain<br />

in occupation <strong>of</strong> the Property for a 2 year period in order to allow them to assess their<br />

longer term housing requirements but on condition that payment <strong>of</strong> the Family Quarter<br />

Charge and CILOCT is made. The following terms apply to this entitlement:<br />

5.5.1 The Service Family Accommodation Charge (which may be liable to change as<br />

a result <strong>of</strong> a 4 Tier Grading Board and/or the annual AFPRB round) and CILOCT (subject<br />

to a 25% abatement for single occupancy) will be payable by Your bereaved<br />
