I would repeat again, court should prove now that<br />
notwithstanding the fact that the political leadership has<br />
changed – judiciary is inviolable. Unfortunately mentality<br />
in our country is that if government changed, everything<br />
should be changed – this is not the democratic way of<br />
development, this would not happen in the democratic<br />
countries. Position of the court – objective and fair<br />
decisions has significant importance for the country,<br />
through our objective decisions we should maintain<br />
independence of this system, this is important for the<br />
country and not for any particular judge. Rule of law state<br />
means restriction of the government through laws, justice,<br />
setting rules as guaranteed by the Constitution for<br />
democratic states, judges know this very well and realize<br />
their functions in this process. They act precisely like<br />
respectful judges should act.<br />
Together with the Prime Minister we discussed existing<br />
gaps, he had questions on specific cases, on procedural<br />
issues in the courts. I provided detailed information to the<br />
Prime Minister on the procedural regulations. For<br />
example, how are cases being assigned, as the law<br />
regulates this. What is the specialization and why did we<br />
introduce it – in order to speed up and raise quality... We<br />
discussed in details similar issues like structural topics<br />
and finally, agreed that there will be no political or other<br />
type of influence on the judiciary. This will be beneficial<br />
not just for the courts, but also for the development of the<br />
country, I told this to the Prime Minister and he agreed.<br />
This was the substance of our meeting.<br />
Thus, despite some small shortcomings, court tries to be<br />
objective and independent, this will lead our Country to<br />
Europe.<br />
Mr. Kote, recently you met with the Prime<br />
Minister, after this meeting, Prime Minister<br />
expressed his sympathy to you as a<br />
professional. It is interesting to know what did<br />
you discuss during the meeting?<br />
– I evaluate positively that the Prime Minister had the<br />
initiative and visited the Supreme Court of Georgia. We<br />
certainly did not speak about myself during the meeting,<br />
we spoke about the situation in the judiciary, successes,<br />
problems, about everything we are discussing now.<br />
Prime Minister stated that he would become guarantee for<br />
the judicial independence, that he would not allow any<br />
representative of his government to influence the courts.<br />
I told the Prime Minister that the latter was the top<br />
priority and if this happens, if the courts are not<br />
influenced, we’ll have respective consequences – courts<br />
will make objective and fair decisions. I told the Prime<br />
Minister: when I meet judges I tell them: although you are<br />
being attacked, do not react emotionally, handle cases<br />
objectively, no matter who is in the government, base<br />
your decisions on the truth.<br />
