Alternative sanctions have big prospects in the criminal law. It is possible to
settle a conflict at an early stage with their help and to prevent psychological
complications among conflicting parties.
Alternative sanctions in criminal law, that are very topical both in Georgia as
well as in European countries, were first applied in England. They were further
spread to Anglo-Saxon and Continental Europe law familycountries.
Application of alternative sanctions for the settlement of social conflicts is
becoming wider in Europe and among them in Georgia, where the institution of
mediation and diversion are more and more actively used in the juvenile justice
field. In the future it would be desirable to apply mediation alsofor adults in the
same active manner as it is done in case of diversion.
