discussions about legislation, the nature <strong>of</strong> the judicial system, concrete<br />

measures aga<strong>in</strong>st discrim<strong>in</strong>ation and participation <strong>of</strong> concerned <strong>in</strong>dividuals,<br />

human rights education and awareness, tra<strong>in</strong><strong>in</strong>g and <strong>in</strong>struction <strong>of</strong> law en<strong>for</strong>cement<br />

personnel, ombudswork and other monitor<strong>in</strong>g systems, response<br />

to civil society <strong>in</strong>itiatives, etc.<br />

Actions <strong>in</strong> these fields depend on political will, but progress cannot be<br />

immediate and also depend on personnel and f<strong>in</strong>ancial resources and other<br />

circumstances. There is a grow<strong>in</strong>g realization that human rights can only be<br />

ensured through a consistent policy <strong>of</strong> such ‘<strong>in</strong>stitution build<strong>in</strong>g’. <strong>Development</strong><br />

co-operation has <strong>in</strong>creas<strong>in</strong>gly been directed towards develop<strong>in</strong>g an<br />

<strong>in</strong>dependent judiciary, tra<strong>in</strong><strong>in</strong>g <strong>of</strong> a pr<strong>of</strong>essional police <strong>for</strong>ce, review<strong>in</strong>g <strong>of</strong><br />

the legislation and encourag<strong>in</strong>g active non-governmental groups.<br />

Such discussions between donors and develop<strong>in</strong>g countries do not exclude<br />

frank exchanges about the current human rights situations. In fact, the<br />

dialogue about capacity development has to be built on an h<strong>one</strong>st assessment<br />

<strong>of</strong> the present <strong>in</strong> order to be mean<strong>in</strong>gful and effective.<br />

<strong>Development</strong> co-operation and human rights<br />

The bilateral dialogue between a donor and a develop<strong>in</strong>g country is usually<br />

conducted at several levels at the same time – dur<strong>in</strong>g m<strong>in</strong>isterial visits <strong>in</strong><br />

both directions, between diplomats or dur<strong>in</strong>g the regular negotiations between<br />

government delegations on future development co-operation. This<br />

is when political views on human rights are <strong>in</strong>tegrated <strong>in</strong>to the discussions<br />

on co-operation.<br />

Develop<strong>in</strong>g countries tend to oppose ‘conditionality’, i.e. that aid be conditi<strong>one</strong>d<br />

on a certa<strong>in</strong> level <strong>of</strong> human rights per<strong>for</strong>mance. At least at <strong>in</strong>ternational<br />

conferences, they have described such conditions as a <strong>for</strong>m <strong>of</strong> blackmail<br />

and suggested that they reflect a neo-colonial attitude and underm<strong>in</strong>e<br />

the spirit <strong>of</strong> mutual respect.<br />

This position is understandable. There could, however, be different <strong>for</strong>ms<br />

<strong>of</strong> ‘conditionality’. One would be that no co-operation is established – or<br />

that ongo<strong>in</strong>g programs are <strong>in</strong>terrupted – if there are serious violations <strong>in</strong> the<br />

recipient country. A s<strong>of</strong>ter <strong>for</strong>m would be that assistance is only provided if<br />

used <strong>for</strong> human rights re<strong>for</strong>m.<br />

<strong>Are</strong> there agreed norms <strong>in</strong> this area? There is a reference <strong>in</strong> the International<br />

Convention on Economic, Social and Cultural Rights, as well as <strong>in</strong><br />

the Convention on the Rights <strong>of</strong> the Child, to <strong>in</strong>ternational co-operation<br />

<strong>in</strong> order to also enable poor countries to implement the standards on, <strong>for</strong><br />

<strong>in</strong>stance, the rights to health and education.<br />

This has been <strong>in</strong>terpreted as a signal that richer countries should be prepared<br />

to assist others <strong>in</strong> their ef<strong>for</strong>ts to realize such costly rights. However,<br />

it would be to stretch the <strong>in</strong>terpretation <strong>of</strong> these provisions to describe<br />

them as def<strong>in</strong>ite obligations to give aid.
