The employee must use any accrued Personal Days while on leave. However,<br />

additional benefits will not be earned du ri ng the leave <strong>of</strong> absence. The leave will<br />

'be subject to the same provisions and rules as apply to medical leaves, except<br />

that employees subject to drug and alcohol testing by provision <strong>of</strong> state andlor<br />

federal law shall only return to work in compliance with the provisions <strong>of</strong> the<br />

Company's Drug and Alcohol Policy.<br />

Eligibility for Leaves<br />

Any employee who Ilas completed at least 12 months <strong>of</strong> service and has worke d<br />

at least 1,250 hours <strong>of</strong> service during the 12-month period preceding the date the<br />

leave would begin may request an unpaid fam ily and med ical leave <strong>of</strong> absence.<br />

An emp l qye~ . must also work within a 75-mile radius <strong>of</strong> 50 or more employees <strong>of</strong><br />

the organization in order to be eligible for a leave under this policy. Subject to<br />

the conditions <strong>of</strong> this policy, eligible employees may request up to 12 weeks<br />

family and medica! leave during a 12-month period. The 12-month period used<br />

under this policy to measure the 12-week lirnitation will be the rolling 12-month<br />

period measured backward from the date an employee uses any leave.<br />

Permi ssible Purposes <strong>of</strong> Fa mily a nd Medica l Leaves<br />

An eligible employee may request a family and medical leave for any <strong>of</strong> the<br />

following reasons: (1) the birth <strong>of</strong> the employee's child; (2) the placement <strong>of</strong> a<br />

child with the employee in connection with an adoption or foster care; (3) to care<br />

for a child, paren·t, or spouse/domestic partner who has a serious health<br />

condition; or (4) due to a serious health condition that prevents the employee<br />

from performing one or more <strong>of</strong> the essential functions <strong>of</strong> his or her position . To<br />

the maximum extent permitted by law, any leave <strong>of</strong> absence that is granted to an<br />

employee under this policy or any other policy for a purpose specified above<br />

shall be credited against the 12-week limit contained in this policy.<br />

Benefits During Leave<br />

An employee who is granted a family and rnedicalleave <strong>of</strong> absence must utilize<br />

any accrued Personal Days during tile pe l·iod <strong>of</strong> the [eave: Any Ilortion <strong>of</strong> a leave<br />

that occurs after all paid time <strong>of</strong>f benefits have been exhausted shall be without<br />

pay. For purposes <strong>of</strong> this policy's 12-week limitation, any paid and unpaid<br />

portions <strong>of</strong> the leave <strong>of</strong> absence shall be added together whether or not they are<br />

taken consecutively.<br />

Health insuran.ce benefits ordinarily provided by Ihe employer, and for which the<br />

employee is otherwise eligible, will be continued during the· period <strong>of</strong> the leave if<br />

the employee elects to continue paying his or her share <strong>of</strong> the premiums for such<br />

coverage. If the employee wishes coverage to continue, the employer wi ll<br />

continue to pay its share <strong>of</strong> the premiums for the period <strong>of</strong> the leave, up to a<br />
