4) Physical altercations, assaults, and' flagrant disregard Of violations<br />

<strong>of</strong> established safety, security, Of other operating procedures.<br />

Reasonable sus'picion referrals must be made by a supervisor who is<br />

trained to detect the signs and symptoms <strong>of</strong> drug and alcohol use and<br />

when conclusion has been made that an employee may be adversely<br />

affected or impaired in his/her work performance due to possible<br />

prohibited substance abuse or alcohol misuse.<br />

Due to the nature <strong>of</strong> this testing, an employee will be accompanied by a<br />

supervisor, until such time as the collection site has begun testing.<br />

8.3 POST-AcCIDENT T ESTING<br />

All sa fety~s en s itive employees will be required to undergo urine and breath<br />

testing if they are involved-in an accident while in the operation <strong>of</strong> a company<br />

'{ehiele that re sults in a fatality. This includes all surviving safety-sensitive<br />

employees that operated the veh icle and any other whose performance<br />

could have contributed to the accident. In addition, a post-accident test<br />

w ill be conducted if an accident results in injuries requiring immediate<br />

transportation to a medical treatment facility, or one or more vehicles<br />

incurs disabling damage, unless the operator can be completely<br />

discounted as a contributing factor to the accident.<br />

Following an accident, the safety-sensitive employee(s) will be tested as<br />

soon as possible, but not to exceed eight (8) hours for alcohol testing and<br />

thirty two (32) hours for drug testing. Any safety-sensitive employee<br />

involved in an accident must refrain from alcohol use for eight (8) hours<br />

following the accident or until he/she undergoes a post-accident alcohol<br />

test. Any safety-sensitive employee who leaves the scene <strong>of</strong> the accident<br />

w ithout justifiable explanation prior to submission to drug and alcohol<br />

testing will be considered to have refused the test, and will be immediately<br />

terminated. Employees tested under this provision w ill include not on ly the<br />

operations personnel, but any other covered employee whose performance<br />

could have contributed to the accident. Additionally, employees who are<br />

required to test under this section will be accompanied by a supervisor until such<br />

time as the collection site personnel have begun testing.<br />

'In some cases, where law enforcement personnel are on scene, employees may<br />

be required to submit to testing <strong>of</strong> their breath alcohol content. In such cases,<br />

wh ere law enforcement personnel are certified to perform such test, the results<br />

will be considered inclusive and obSBlved by the company as a valid postaccident<br />

alcohol test.<br />

8.4 RANDOM TESTING<br />

Employees in safety-sensitive positions will be subjected to random,<br />

unannounced testing. The selection <strong>of</strong> safety-sensitive employees for random<br />
