4) Physical altercations, assaults, and' flagrant disregard Of violations
of established safety, security, Of other operating procedures.
Reasonable sus'picion referrals must be made by a supervisor who is
trained to detect the signs and symptoms of drug and alcohol use and
when conclusion has been made that an employee may be adversely
affected or impaired in his/her work performance due to possible
prohibited substance abuse or alcohol misuse.

Due to the nature of this testing, an employee will be accompanied by a
supervisor, until such time as the collection site has begun testing.
8.3 POST-AcCIDENT T ESTING
All sa fety~s en s itive employees will be required to undergo urine and breath
testing if they are involved-in an accident while in the operation of a company
'{ehiele that re sults in a fatality. This includes all surviving safety-sensitive
employees that operated the veh icle and any other whose performance
could have contributed to the accident. In addition, a post-accident test
w ill be conducted if an accident results in injuries requiring immediate
transportation to a medical treatment facility, or one or more vehicles
incurs disabling damage, unless the operator can be completely
discounted as a contributing factor to the accident.
Following an accident, the safety-sensitive employee(s) will be tested as
soon as possible, but not to exceed eight (8) hours for alcohol testing and
thirty two (32) hours for drug testing. Any safety-sensitive employee
involved in an accident must refrain from alcohol use for eight (8) hours
following the accident or until he/she undergoes a post-accident alcohol
test. Any safety-sensitive employee who leaves the scene of the accident
w ithout justifiable explanation prior to submission to drug and alcohol
testing will be considered to have refused the test, and will be immediately
terminated. Employees tested under this provision w ill include not on ly the
operations personnel, but any other covered employee whose performance
could have contributed to the accident. Additionally, employees who are
required to test under this section will be accompanied by a supervisor until such
time as the collection site personnel have begun testing.
'In some cases, where law enforcement personnel are on scene, employees may
be required to submit to testing of their breath alcohol content. In such cases,
wh ere law enforcement personnel are certified to perform such test, the results
will be considered inclusive and obSBlved by the company as a valid postaccident
alcohol test.
8.4 RANDOM TESTING
Employees in safety-sensitive positions will be subjected to random,
unannounced testing. The selection of safety-sensitive employees for random
