SUMMARY<br />

On January 25, 2010, the TPC reviewed and approved the Appellant's application for the<br />

renewal <strong>of</strong> its taxicab owner's permit to operate 15 taxicabs in <strong>Glendale</strong>. The TPC's approval<br />

was limited to a term <strong>of</strong> 3 years, 10 months and 20 days (December 15, 2013). The TPC<br />

calculated the expiration date to coincide with the expiration date <strong>of</strong> the next longest taxicab<br />

owner's permit and to eventually cause all taxicab owners' permits to expire simultaneously.<br />

The TPG's decision is a departure from the <strong>City</strong>'s customary process to grant all taxicab owners<br />

the maximum term <strong>of</strong> 5 years. By granting the Appellant a shorter permit term, the TPC was<br />

attempting to establish a process whereby all taxicab applications would eventually come to the<br />

TPC at which time the TPC would consider how to increase the diversity <strong>of</strong> ownership among<br />

the taxicab operators in the <strong>City</strong>.<br />

The TPC's decision is further complicated by vagueness in Title 5.84 <strong>of</strong> the <strong>Glendale</strong> Municipal<br />

Code, 1995 ("GMC"). GMC Sec. 5.84.100 states that the <strong>City</strong> Clerk issues owner's permit<br />

certificates for a period "not to exceed five years." However, the GMC does not specify the<br />

criteria by which a permit could have a term <strong>of</strong> less than five years nor does it state what body<br />

determines the length <strong>of</strong> the term-the <strong>City</strong> Clerk or the TPC. Because the TPC had the original<br />

authority to grant or deny operator's permit, it is the <strong>City</strong> Attorney's opinion that Sec. 5.84.100<br />

was intended to grant the TPC the authority to determine the term <strong>of</strong> an operator's permit for a<br />

period <strong>of</strong> time not to exceed 5 years. The Clerk's authority would be limited to issuing a<br />

certificate for a period <strong>of</strong> time not to exceed 5 years.<br />

As discussed in further detail below, the Appellant objects to the shortened duration <strong>of</strong> the<br />

permit and is seeking approval from the Council to operate for a full five-year term as has been<br />

the TPC's customary practice.<br />

FISCAL IMPACT<br />

There would be no direct fiscal impact to the <strong>City</strong> as a result <strong>of</strong> any <strong>of</strong> the motions or the<br />

recommended actions in this matter.<br />

The appellant seeks Council approval <strong>of</strong> a full 5-year term for its taxicab<br />

owner's permit.<br />

The <strong>City</strong> Clerk's Office received Appellant's renewal application to<br />

operate 15 taxicab vehicles in <strong>Glendale</strong>. The application was properly<br />

submitted to the <strong>City</strong> Clerk within the filing window period as specified in<br />

the <strong>Glendale</strong> Municipal Code, 1995 ("GMC"). A copy <strong>of</strong> the renewal<br />

application is attached hereto as Exhibit A,<br />

The TPC held a public hearing to consider Appellant's renewal<br />

application. Staff recommended granting the renewal. Copies <strong>of</strong> the TPC<br />

minutes, motion and staff report are attached hereto as Exhibit B.<br />
