d, The character, experience and responsibility <strong>of</strong><br />

the applicant as detenl1illed tlu·ough rhe application<br />

and background investigation:<br />

2. The commissiOll may determine the maximulll<br />

number <strong>of</strong> taxicab vehicle licenses available TO<br />

owner's pennit applicants or applicants for additional<br />

vehicles for existing taxicab owners pursuant to Sec~<br />

tion 5.84.070, by using the following methodology:<br />

a. Itl the event the city receives no more than one<br />

application fo r a taxicab owner's pennit pursuant to<br />

Section 5.84.090 or fo r additional taxicab vehicle licenses<br />

pursuant to Section 5.84.070, the commission<br />

may award to said applicant any number <strong>of</strong> taxicab<br />

vehicle licenses up to and including ten percent <strong>of</strong>the<br />

existing taxicab vehicle licenses currently issued and<br />

in lise in the city as <strong>of</strong> July 1 <strong>of</strong> the year sa id applicalion<br />

is under consideration but in no event' shall the<br />

lolal number <strong>of</strong> taxicab vehicle licenses exceed the<br />

maximum amount established by the city council or<br />

the commission pursuant to Section 5.84.1 OO(C)(J).<br />

b. In the event the city receives two or more<br />

applications for ncw taxicab owner's pennits pursuant<br />

to Section 5.84.090 or for additional taxjcab vebicle<br />

licenses pursuantto Section 5.84.070, theconunission<br />

'may a llocate among said applicanls a total number <strong>of</strong><br />

vehicle licenses up to and including ten percent <strong>of</strong>the<br />

existing vehicle licenses currently issued and ill use in<br />

the city as <strong>of</strong> July J <strong>of</strong> the year said applications are<br />

under consideration but in no event shall the total<br />

number <strong>of</strong> taxicab vehicle licenses exceed the maximum<br />

amount established by the cily council or the<br />

commission pursuant 10 Section 5.84.1 OO(C)(!).<br />

C. Any unallocated vebicle licenses may be available<br />

for allocation the following year and each successive<br />

year until all vehicles up to Ihe maximum amount<br />

pursuant to Section 5.84.IOO(C)( I) are allocated.<br />

D . Owner's permits shall become effective upon<br />

approval and fmdings <strong>of</strong> fact by the commission subjcctto<br />

celtification by the city clerk that the vehicle(s)<br />

lisled under the application comply with the requi rements<br />

<strong>of</strong> Section 5.84.370.<br />

E. Upon being granted an owner's permit, the applicant<br />

shall have ninety days from the dale <strong>of</strong> commission<br />

approval to install alllhcnecessary equipment<br />

required by Ihis chapter 011 the vehicle(s) listed under<br />

the application. Said nincty-day time period is so let ~<br />

for the Pl.Ilvose <strong>of</strong> permitting lhe applicam (ime to expend<br />

the funds necessal)' to propcrly outfit said vehicle(s)<br />

and does not grant any right to operate said vebicle(s)<br />

prior to the city clerk's certification.<br />

F. In the evcnt a person possessing an owner·s<br />

pennit does nol obtain al1 the vehicle licenses as all o­<br />

cated to said person by the commission, said person is<br />

precluded from obtaining additional vehicles until the<br />

following application acceptance period whereupon<br />

said person may apply fo r additional vehicles over the<br />

number in use by said person pursuant to the procedure<br />

set forth in Section 5.84.070.<br />

G. If, upon inspection, the vehicJe(s) described in<br />

the application are found to comply with the requirements<br />

<strong>of</strong> this chapter, the city clerk shall certify said<br />

vehicles, issue an owner's pennit celtificate pursuant<br />

to Section 5.84.060 for a period <strong>of</strong>timc not to exceed<br />

five years, and issue an mmual vchicle license for each<br />

vehicle pursuant to Section 5.84.370. All persons possessi.ng<br />

owner's pelmits must reapply within theapplicalion<br />

acceptance period pursuant to Section 5.84.090<br />

within sufficicnt ti me so as to prevent such owner's<br />

permits from expiring.<br />

H. lffor any reason the city clerk dcnies certificalion<br />

<strong>of</strong> any vehicle(s) described in the applicant's<br />

owner's perrnit application, said application shall be<br />

subject to denial pursuant to Section 5.84.1 10. (Ord.<br />

20-46)<br />

5.84.103 Public convcni ence a nd necessityli'indings<br />

by co mmission.<br />

A. The commission, when considering findings for<br />

public convenience and necessity as set forth in Section<br />

5.84. 100, may consider, but is not limitcd to, the<br />

followi.ng factors:<br />

I. Appl icanl meets all the requirements set forth<br />

in this chapter;<br />

2. Applicant has provided sufficient pro<strong>of</strong> <strong>of</strong> all <strong>of</strong><br />

the following:<br />

a. Experience in the business for which he or she<br />

is applying,<br />
