2. The commissiOll may determine the maximulll
number of taxicab vehicle licenses available TO
owner's pennit applicants or applicants for additional
vehicles for existing taxicab owners pursuant to Sec~
tion 5.84.070, by using the following methodology:
a. Itl the event the city receives no more than one
application fo r a taxicab owner's pennit pursuant to
Section 5.84.090 or fo r additional taxicab vehicle licenses
pursuant to Section 5.84.070, the commission
may award to said applicant any number of taxicab
vehicle licenses up to and including ten percent ofthe
existing taxicab vehicle licenses currently issued and
in lise in the city as of July 1 of the year sa id applicalion
is under consideration but in no event' shall the
lolal number of taxicab vehicle licenses exceed the
maximum amount established by the city council or
the commission pursuant to Section 5.84.1 OO(C)(J).
b. In the event the city receives two or more
applications for ncw taxicab owner's pennits pursuant
to Section 5.84.090 or for additional taxjcab vebicle
licenses pursuantto Section 5.84.070, theconunission
'may a llocate among said applicanls a total number of
vehicle licenses up to and including ten percent ofthe
existing vehicle licenses currently issued and ill use in
the city as of July J of the year said applications are
under consideration but in no event shall the total
number of taxicab vehicle licenses exceed the maximum
amount established by the cily council or the
commission pursuant 10 Section 5.84.1 OO(C)(!).
C. Any unallocated vebicle licenses may be available
for allocation the following year and each successive
year until all vehicles up to Ihe maximum amount
pursuant to Section 5.84.IOO(C)( I) are allocated.
D . Owner's permits shall become effective upon
approval and fmdings of fact by the commission subjcctto
celtification by the city clerk that the vehicle(s)
lisled under the application comply with the requi rements
of Section 5.84.370.
E. Upon being granted an owner's permit, the applicant
shall have ninety days from the dale of commission
approval to install alllhcnecessary equipment
required by Ihis chapter 011 the vehicle(s) listed under
the application. Said nincty-day time period is so let ~
for the Pl.Ilvose of permitting lhe applicam (ime to expend
the funds necessal)' to propcrly outfit said vehicle(s)
and does not grant any right to operate said vebicle(s)
prior to the city clerk's certification.
F. In the evcnt a person possessing an owner·s
pennit does nol obtain al1 the vehicle licenses as all o­
cated to said person by the commission, said person is
precluded from obtaining additional vehicles until the
following application acceptance period whereupon
said person may apply fo r additional vehicles over the
number in use by said person pursuant to the procedure
set forth in Section 5.84.070.
G. If, upon inspection, the vehicJe(s) described in
the application are found to comply with the requirements
of this chapter, the city clerk shall certify said
vehicles, issue an owner's pennit celtificate pursuant
to Section 5.84.060 for a period oftimc not to exceed
five years, and issue an mmual vchicle license for each
vehicle pursuant to Section 5.84.370. All persons possessi.ng
owner's pelmits must reapply within theapplicalion
acceptance period pursuant to Section 5.84.090
within sufficicnt ti me so as to prevent such owner's
permits from expiring.
H. lffor any reason the city clerk dcnies certificalion
of any vehicle(s) described in the applicant's
owner's perrnit application, said application shall be
subject to denial pursuant to Section 5.84.1 10. (Ord.

5.84.103 Public convcni ence a nd necessityli'indings
by co mmission.
A. The commission, when considering findings for
public convenience and necessity as set forth in Section
5.84. 100, may consider, but is not limitcd to, the
followi.ng factors:
I. Appl icanl meets all the requirements set forth
in this chapter;
2. Applicant has provided sufficient proof of all of
the following:
a. Experience in the business for which he or she
is applying,
