Drug testing can be performed any time an STI employee is on duty. Alcohol<br />

testing can be performed any time an STI employee is on duty, and just befqre or<br />

just after for safety-sensitive employees. -<br />

6.5 TREATMENT GUIDELINES<br />

Southland Transit, Inc. acknowledges the inherent risks associated with the<br />

operation <strong>of</strong> a public transit vehicle while under the influence <strong>of</strong> a performance<br />

deteriorating substanr:;e. Accordingly, employees found to be in violation <strong>of</strong> this<br />

policy will be subject to disciplinary action, up to and including termination.<br />

However, STI recognizes chemical dependency as a medical problem, which can<br />

be successfully treated. As such, employees who seek assistance and selfdiscloses<br />

his/her dependency <strong>of</strong> a controlled substance in a manner that meets<br />

the guidelines established in this section may be considered for continu ed<br />

employment. Those employees who seek assistance following a notification <strong>of</strong><br />

testing will be referred to an employee assistance program, but may not be<br />

considered for continued employment. Any employee who refuses or fails to<br />

comply with the guidelines established in this section and with the subsequent<br />

treatment, after care, and return to duty testing requirements, may not be<br />

considered for continued employment. The cost <strong>of</strong> any treatment or rehabilitation<br />

services will be paid for directly by the employee, through their insurance<br />

provider or otherwise. Southland Transit, Inc. is not responsible for the costs <strong>of</strong><br />

any treatment.<br />

The following are treatment guidelines used in determining eligibility for<br />

continued employment:<br />

A) Employee must seek assistance and self-disclose that he/she has a<br />

chemical dependency prior to being subject to and/or receiving<br />

notification <strong>of</strong> testing for the presence <strong>of</strong> drugs, alcohol, or any<br />

other substance which is known to affect motor skills, as_prescribed<br />

in this policy.<br />

B) Employee must submit to a Drug & Alcohol test immedialely<br />

following his/her disclosure, or as determined by management, in<br />

order to confirm his/her cla im for treatment, and to determine the<br />

type <strong>of</strong> treatment required. The test result must be consistent with<br />

the employees claim before qualifying for the program. Regardless<br />

<strong>of</strong> test result, the employee will be referred to an employee<br />

assistance program.<br />

C) Employee must comply with all other requirements, as defined in<br />

Section 8.5 and 8.6 <strong>of</strong> this policy.<br />

Employees receiving treatment for chemical dependency are not shielded from<br />

disciplinary action.<br />
