Employees who are qualified to attend these assistance programs as a measure<br />
for continued employment may use Personal Time Off (PTO), as available.<br />
6.6 NOTIFICATION TO EMPLOYER OF CRIMINAL DRUG CONVICTION<br />
All employees are required to notify Southland Transit, Inc. <strong>of</strong> any criminal drug<br />
statute conviction for a violation occurring in the workplace within five days after<br />
such conviction. Failure to comply with this provision wi ll result in immediate<br />
termination.<br />
6.7 POLlCY AOMINISTRATION<br />
Southland Transit, Inc. is dedicated to assuring fair and equitable application <strong>of</strong><br />
this policy. Therefore, supervisors/managers are required to use and apply all<br />
aspects <strong>of</strong> this policy in a manner that is unbiased and impartial. Any<br />
supervisor/manager who knowingly disregards the requirements <strong>of</strong> this policy, or<br />
who is found to deliberately misuse the policy in regard to subordinates, shall be<br />
subject to disciplinary action in accordance with the provisions set forth in the<br />
Employee Handbook manual.<br />

7.0 TESTING PROTOCAL Procedure<br />
Employees <strong>of</strong> STI shall have on their person, a valid California Driver's License<br />
(Commercial or otherwise). This identification is required during testing in order<br />
to enswe the identity <strong>of</strong> the provider, and validate subsequent test result. Failure<br />
to .present this or another form <strong>of</strong> identification to the collection site may be<br />
considered as an obstruction to the testing integrity and subsequent refusal, as<br />
defined in Section 6.4, subpart 1 <strong>of</strong> this policy.<br />
7.1 TESTING CIRCUMSTANCES<br />
Analytical urine drug testing and breath testing for alcohol may be conducted<br />
Wfien circumstances warrant or as required by Federal regulations. All safety~<br />
sensitive employees shall be subject to drug testing pri or to employment,<br />
for reasonable suspicion, and following an accident as defined in Sections<br />
8.1, 8.2, and 8.3 <strong>of</strong> this policy. In addition, all safety·sensitive employees will<br />
be tested prior to returning to duty, where applicable, after failing a dru g or<br />
alcohol test and after completion <strong>of</strong> the Substance Abuse Pr<strong>of</strong>essional's<br />
recommended treatment program and 'subsequent release to duty. FolioWRUP<br />
testing will also be conducted following return to duty for a period <strong>of</strong> one<br />
(1) to five (5) years, with at least six (6) tests performed during the f irst<br />
year. The frequency <strong>of</strong> these tests will only be made known to the company, and<br />
are determined by the Substance Abuse Pr<strong>of</strong>essional.<br />
