An Apprentice may elect to be paid a tool allowance <strong>of</strong> their current progression<br />

wage percentage <strong>of</strong> $74.00 providing the apprentice has maintained the required<br />

tools at his place <strong>of</strong> work during the year.<br />

COMPLETION OF PROGRAM<br />

Upon successful completion <strong>of</strong> the courses, the employee agrees to remain in<br />

the employ <strong>of</strong> the <strong>City</strong> <strong>of</strong> <strong>Hamilton</strong> for a period <strong>of</strong> two (2) years.<br />

Should the employee choose to leave the <strong>City</strong> <strong>of</strong> <strong>Hamilton</strong> within the first year <strong>of</strong><br />

the two-year period mentioned above, s/he acknowledges that the amount <strong>of</strong><br />

wages paid to the employee during the first year <strong>of</strong> the classroom portion <strong>of</strong> the<br />

course represents a debt which the <strong>City</strong> <strong>of</strong> <strong>Hamilton</strong> may satisfy through<br />

deductions from wages, vacation pay or other appropriate means.<br />

Should the employee choose to leave the <strong>City</strong> <strong>of</strong> <strong>Hamilton</strong> within the 2nd year <strong>of</strong><br />

the two-year period mentioned above, s/he acknowledges that half <strong>of</strong> the amount<br />

<strong>of</strong> wages paid to the employee during the first year <strong>of</strong> the classroom portion <strong>of</strong><br />

the course represents a debt which the <strong>City</strong> <strong>of</strong> <strong>Hamilton</strong> may satisfy through<br />

deductions from wages, vacation pay or other appropriate means.<br />

PROGRESS ASSEMSSMENTS<br />

Regular progress assessments will be conducted. These shall not be subject to<br />

the grievance procedure. The Manager <strong>of</strong> <strong>Transit</strong> Fleet Maintenance, based on<br />

the requirements and guidelines <strong>of</strong> the Apprenticeship Program, will have sole<br />

discretion to decide if progress and performance are adequate to continue in the<br />

Apprenticeship Program.<br />

DISPUTE COMMITTEE<br />

All complaints and/or disputes pertaining to this program shall be referred to a<br />

joint committee consisting <strong>of</strong> the Director <strong>of</strong> <strong>Transit</strong> (Chair), the Manager <strong>of</strong><br />

<strong>Transit</strong> Fleet Maintenance (or designate), the President <strong>of</strong> <strong>Local</strong> <strong>107</strong> <strong>ATU</strong> (or<br />

designate), the Director <strong>of</strong> Labour Relations (or designate), the <strong>Local</strong> <strong>107</strong> <strong>ATU</strong><br />

Executive Steward for Maintenance (or designate) and the applicable Provincial<br />

Apprenticeship Advisor (as a non-voting member). All decisions <strong>of</strong> the Dispute<br />

Committee are final.<br />

EMPLOYEE CONSENT<br />

Employees participating in the program shall be required to sign consents<br />

reflective <strong>of</strong> their obligation under the terms and conditions <strong>of</strong> this agreement.<br />
