Approved bridging forms will be supplied by the Employer and signed upon<br />

hiring. The Employer will ensure all Employees have had an opportunity to sign<br />

the appropriate bridging forms.<br />

LETTER OF UNDERSTANDING - BARTON ARBITRATION - RUNS<br />

GREATER THAN 8.5 HOURS IN LENGTH<br />

The Barton arbitration concludes that the <strong>Union</strong> "is entitled to a declaration that<br />

any runs over eight and one-half hours per day violate the Collective Agreement."<br />

The union and the <strong>City</strong> (HSR) subsequently agreed that it would take time to<br />

become completely compliant without dramatically affecting the current<br />

runcutting process and the resultant runcut.<br />

To that end, the <strong>Union</strong> recognizes that the <strong>City</strong> (HSR) has been taking the<br />

following actions:<br />

• ongoing hiring <strong>of</strong> operators.<br />

modifying the current runcuts to reduce the length <strong>of</strong> runs and the number<br />

<strong>of</strong> runs exceeding 8.5 hours when possible.<br />

The <strong>Union</strong> further recognizes that the following factors have made the situation<br />

more difficult in reaching compliance as soon as desired:<br />

Including pull in/out time as "work" time has had the effect <strong>of</strong> adding up to<br />

forty (40) minutes to some runs, making what would have been runs less<br />

than 8.5 hours now greater than 8.5 hours, and therefore non-compliant.<br />

The relocation to the MTC for the June 2000 board has added a<br />

considerable amount <strong>of</strong> additional deadhead to many runs, again making<br />

compliant runs, non-compliant.<br />

The efforts to centralize, as much as possible, the relief points to the<br />

downtown area to decrease unpaid operator travel time between the<br />

beginning and ends <strong>of</strong> runs (i.e. starting at MTC and finishing at Gore Park<br />

instead <strong>of</strong> Eastgate Square) has restricted the flexibility within the runcut,<br />

again forcing otherwise compliant runs to become non-compliant.<br />

The commitment to provide some form <strong>of</strong> a relief shuttle bus between the<br />

downtown area and the MTC starting with the June 2000 board, which<br />

shall require a reallocation <strong>of</strong> manpower. The <strong>Union</strong> is requesting half<br />

hour shuttle service between the hours <strong>of</strong> 5:30am through 7:30 pm, seven<br />

days per week from the core to the MTC as well as from non-core relief<br />

points (Ancaster, Stoney Creek, Parkdale, Stone Church).<br />
